【摘要】:隨著我國(guó)經(jīng)濟(jì)的發(fā)展和生態(tài)環(huán)境的惡化,生態(tài)保護(hù)問(wèn)題越來(lái)越受到人們的關(guān)注。由于受到特殊地理位置和歷史淵源的影響,黔東南從江縣侗族地區(qū)形成了比較有特色的自然和人文景觀。侗族生態(tài)習(xí)慣法作為侗族傳統(tǒng)文化的一個(gè)有機(jī)組成部分,對(duì)當(dāng)?shù)囟弊宕迕竦挠绊懯菨撘颇?涉及侗族村民們生產(chǎn)、生活的方方面面,并且該習(xí)慣法對(duì)侗族村民具有相當(dāng)?shù)臋?quán)威性,使得侗族生態(tài)習(xí)慣法在國(guó)家環(huán)境制定法存在不少缺陷的情況下,在黔東南從江縣侗族地區(qū)發(fā)揮了重要的作用。因此探索和研究黔東南從江縣三個(gè)行政村的侗族生態(tài)習(xí)慣法問(wèn)題,不僅可以彌補(bǔ)我國(guó)環(huán)境制定法在某些方面的不足,而且對(duì)于促進(jìn)民族地區(qū)經(jīng)濟(jì)、社會(huì)的可持續(xù)發(fā)展也有重要的意義。筆者在田野調(diào)查及定性研究的基礎(chǔ)上,撰寫(xiě)完畢本篇調(diào)研報(bào)告。定性研究不同于定量研究,它以描述和解釋為主,本文通過(guò)描述調(diào)研的內(nèi)容,再現(xiàn)被訪問(wèn)人的觀點(diǎn)和對(duì)話片段,并且用調(diào)研的結(jié)果來(lái)驗(yàn)證本文的觀點(diǎn)。本文主要內(nèi)容如下:緒論部分介紹了筆者選擇該課題的意義、國(guó)內(nèi)外研究現(xiàn)狀、田野調(diào)查的基本情況。第一部分主要介紹了從江縣三個(gè)行政村侗族生態(tài)習(xí)慣法的內(nèi)容。通過(guò)田野調(diào)查,結(jié)合文獻(xiàn)資料,詳細(xì)地展示了從江縣三個(gè)行政村侗族生態(tài)習(xí)慣法從保護(hù)森林資源、水土資源、野生動(dòng)物資源三方面的基本內(nèi)容,并且論述了對(duì)破壞生態(tài)資源的懲罰制度。第二部分著重介紹從江縣三個(gè)行政村侗族生態(tài)習(xí)慣法的表現(xiàn)形式。通過(guò)對(duì)當(dāng)?shù)囟弊迳鷳B(tài)習(xí)慣法的神靈崇拜及禁忌、民族習(xí)俗、寨規(guī)民約與村規(guī)民約三種表現(xiàn)形式的闡述,挖掘從江縣侗族生態(tài)習(xí)慣法在歷史長(zhǎng)河中的變遷,爭(zhēng)取全方面、多維度地體現(xiàn)和研究黔東南從江縣侗族生態(tài)習(xí)慣法的運(yùn)行模式。第三部分主要介紹從江縣三個(gè)行政村侗族生態(tài)習(xí)慣法在現(xiàn)實(shí)生活中的具體實(shí)施情況。根據(jù)調(diào)研所獲得的資料,通過(guò)對(duì)寨老制度和羅漢制度的介紹,展示了當(dāng)?shù)厥侨绾瓮ㄟ^(guò)外部的力量來(lái)保障侗族生態(tài)習(xí)慣法實(shí)施的效果的。第四部分主要對(duì)從江縣三個(gè)行政村侗族生態(tài)習(xí)慣法進(jìn)行思考。從法社會(huì)學(xué)的角度出發(fā),通過(guò)對(duì)從江縣侗族生態(tài)習(xí)慣法的價(jià)值和局限兩方面進(jìn)行探討,進(jìn)而提出延續(xù)和擴(kuò)展從江縣侗族生態(tài)習(xí)慣法生命力的建議,為侗族地區(qū)的法治建設(shè)乃至經(jīng)濟(jì)社會(huì)的發(fā)展提供切實(shí)可行的建議。
[Abstract]:With the development of our country's economy and the deterioration of ecological environment, people pay more and more attention to the problem of ecological protection, because of the influence of special geographical location and historical origin. As an organic part of the traditional culture of Dong nationality, the ecological customary law of Dong nationality has a subtle influence on the local Dong villagers. It involves all aspects of the production and life of the Dong villagers, and the customary law has considerable authority on the Dong villagers, which makes the Dong ecological customary law have many defects in the national environmental law. It plays an important role in the Dong nationality area of Congjiang County in the southeast of Guizhou. Therefore, it explores and studies the ecological customary law of the Dong nationality in the three administrative villages of Congjiang County, Southeast Guizhou Province. Not only can we make up for the deficiency of our country's environmental law in some aspects, but also have important significance to promote the sustainable development of the economy and society in the minority areas. The author is based on the field investigation and qualitative research. The qualitative research is different from the quantitative research. It is mainly about description and explanation. By describing the content of the research, this paper reproduces the views and dialogue fragments of the interviewees. The main contents of this paper are as follows: the introduction part introduces the significance of the author's choice of this topic and the current research situation at home and abroad. The first part mainly introduces the contents of ecological customary law of Dong nationality in three administrative villages of Congjiang County. The ecological customary law of Dong nationality in three administrative villages of Congjiang County is presented in detail, which includes three aspects: protection of forest resources, soil and water resources, and wildlife resources. The second part mainly introduces the manifestation of ecological customary law of Dong nationality in three administrative villages of Congjiang county. Through the worship of gods and taboos of local ecological customary law of Dong nationality. National custom, zhazhaimin covenant and village rules and regulations of three forms of expression, excavated from the river in the history of the Dong ecological customary law changes, strive for all aspects. The third part mainly introduces the implementation of the ecological customary law of Dong nationality in three administrative villages of Congjiang county in real life. Information obtained. Through the introduction of the old system and Luo Han system. Show how the local forces to protect the implementation of ecological customary law of Dong through external forces. Part 4th mainly from the three administrative villages in Conjiang County Dong ecological customary law thinking. From the perspective of sociology of law. Through discussing the value and limitation of the ecological customary law of Dong nationality in Congjiang County, this paper puts forward some suggestions on extending and expanding the vitality of ecological customary law of Dong nationality in Congjiang County. To provide practical suggestions for the construction of the rule of law and even the development of economy and society in Dong nationality area.
