【摘要】： 研究背景 實施衛(wèi)生監(jiān)督體制改革后,多數(shù)地方醫(yī)療機(jī)構(gòu)行政執(zhí)法工作納入衛(wèi)生監(jiān)督機(jī)構(gòu)日常工作內(nèi)容,醫(yī)療機(jī)構(gòu)行政執(zhí)法工作取得了顯著的成效。但是隨著社會經(jīng)濟(jì)的迅速發(fā)展,流動人口的增加,醫(yī)療服務(wù)需求過快增長,醫(yī)療機(jī)構(gòu)呈多元化方向發(fā)展,醫(yī)療市場競爭越來越激烈,致使醫(yī)療機(jī)構(gòu)超范圍執(zhí)業(yè)和聘用非衛(wèi)技人員等違法行為時有發(fā)生,擾亂了醫(yī)療市場秩序,損害了群眾的健康利益。調(diào)查研究威海市醫(yī)療機(jī)構(gòu)存在的問題,有針對性的加強(qiáng)衛(wèi)生監(jiān)督管理,對保護(hù)人民群眾的健康權(quán)益是非常必要和有意義的。 研究目的 通過對威海市區(qū)545所醫(yī)療機(jī)構(gòu)進(jìn)行調(diào)查研究,以了解威海市區(qū)醫(yī)療機(jī)構(gòu)依法執(zhí)業(yè)現(xiàn)狀,醫(yī)療機(jī)構(gòu)存在的問題及原因,并針對存在的問題及原因提出對策和建議,以強(qiáng)化對醫(yī)療機(jī)構(gòu)的日常監(jiān)管,進(jìn)一步規(guī)范醫(yī)療市場、整頓社會主義市場經(jīng)濟(jì)秩序、提高綜合執(zhí)法能力提供依據(jù),保護(hù)人民群眾的健康權(quán)益。 研究方法 本研究對威海市區(qū)醫(yī)療機(jī)構(gòu)采用普查、查閱文獻(xiàn)等方法,設(shè)計《醫(yī)療機(jī)構(gòu)基本情況登記表》,由經(jīng)過統(tǒng)一培訓(xùn)的醫(yī)療衛(wèi)生監(jiān)督員對威海市區(qū)醫(yī)療機(jī)構(gòu)進(jìn)行調(diào)查,分綜合醫(yī)院、專科醫(yī)院、民營醫(yī)院、鄉(xiāng)鎮(zhèn)衛(wèi)生院、門診部、社區(qū)衛(wèi)生服務(wù)站、廠礦衛(wèi)生室、村衛(wèi)生室、個體診所九類進(jìn)行登記,并對獲取的結(jié)果進(jìn)行分析。 研究結(jié)果 總體情況是,自威海市545家醫(yī)療機(jī)構(gòu)調(diào)查結(jié)果表明,共有346家基本符合各項法律法規(guī)及規(guī)章要求,總體合格率為63%；共有497家醫(yī)療機(jī)構(gòu)已按照《醫(yī)療機(jī)構(gòu)管理條例》要求,已取得《醫(yī)療機(jī)構(gòu)執(zhí)業(yè)許可證》,總體持證率為91%；共有450家已按照《醫(yī)療機(jī)構(gòu)管理條例》及《醫(yī)療機(jī)構(gòu)管理條例實施細(xì)則》要求,按期進(jìn)行年度校驗,總體按期校驗率為82%；共有419家按照《醫(yī)療機(jī)構(gòu)管理條例》及《醫(yī)療機(jī)構(gòu)管理條例實施細(xì)則》要求,在衛(wèi)生行政部門核準(zhǔn)的診療科目范圍內(nèi)開展診療活動,總體合格率為77%；共有477家醫(yī)療機(jī)構(gòu)按照《醫(yī)療廣告管理辦法》要求,未違法發(fā)布醫(yī)療廣告,總體合格率為88%；共有371家符合《消毒管理辦法》的要求,消毒設(shè)施設(shè)備及專業(yè)消毒人員均已配備齊全,有消毒記錄和消毒監(jiān)測記錄,總體合格率為68%；共有428家醫(yī)療機(jī)構(gòu)從業(yè)人員符合《中華人民共和國執(zhí)業(yè)醫(yī)師法》、《護(hù)士管理辦法》、《外國醫(yī)師來華短期行醫(yī)暫行管理辦法》、《醫(yī)師執(zhí)業(yè)注冊暫行辦法》要求合法執(zhí)業(yè),總體合格率為79%。 結(jié)論與建議 根據(jù)調(diào)查分析研究,本文得出的結(jié)論是：部分醫(yī)療機(jī)構(gòu)非法處置醫(yī)療廢物存在安全隱患,院內(nèi)感染、消毒管理存在薄弱環(huán)節(jié),部分醫(yī)療機(jī)構(gòu)超范圍開展診療科目,聘用非衛(wèi)生技術(shù)人員,非法發(fā)布醫(yī)療廣告等問題,醫(yī)療資源配置不合理,醫(yī)療技術(shù)人員相對過剩,而且我國現(xiàn)行衛(wèi)生監(jiān)督法規(guī)體制相對滯后不能適應(yīng)醫(yī)療衛(wèi)生監(jiān)督需求。 本文提出的建議是：加強(qiáng)對醫(yī)療機(jī)構(gòu)醫(yī)療廢物管理的執(zhí)法監(jiān)督力度；加強(qiáng)醫(yī)療機(jī)構(gòu)院內(nèi)感染與消毒管理工作；加強(qiáng)醫(yī)療機(jī)構(gòu)依法執(zhí)業(yè)的法律培訓(xùn)；醫(yī)療執(zhí)法要以人為本,服務(wù)為主；加強(qiáng)醫(yī)療機(jī)構(gòu)年度校驗管理工作；加強(qiáng)醫(yī)療廣告的監(jiān)督管理；全面推廣醫(yī)療機(jī)構(gòu)量化分級管理制度；完善法律法規(guī)；建立醫(yī)療舉報投訴案件查處制度；發(fā)揮媒體作用,加強(qiáng)輿論監(jiān)督；多部門協(xié)調(diào),形成監(jiān)管合力；加強(qiáng)行業(yè)管理,充分發(fā)揮行業(yè)協(xié)會的作用。
