【摘要】：侵犯虛構(gòu)人物形象權(quán)常有兩種情形：一是未經(jīng)權(quán)利人許可，將他創(chuàng)作的人物形象作商業(yè)性使用。最典型的是將在社會(huì)上有廣泛知名度的虛構(gòu)人物形象用在企業(yè)的商標(biāo)、商號(hào)、產(chǎn)品外觀設(shè)計(jì)及廣告中，有些還將人物形象的平面圖象做成立體圖形的產(chǎn)品，，從而獲得非正當(dāng)利益。這種情況要...
[Abstract]:There are two kinds of situations of violation of the right of fictional character : Firstly , it is the commercial use of the image of the human being created without the permission of the right . The most typical is to use the fictitious character image of wide popularity in the society to be used in the trademark , the firm , the product design and the advertisement of the enterprise , some of which also make the plan of the figure of the characters into the product of the three - dimensional graphic , thus obtaining the non - legitimate interest .
