隨著國家知識產(chǎn)權(quán)戰(zhàn)略的深入實(shí)施以及對外開放水平的不斷提高,我國越來越重視對外知識產(chǎn)權(quán)交流,特別是知識產(chǎn)權(quán)立法交流。由于英美國家在知識產(chǎn)權(quán)立法方面積聚了豐富經(jīng)驗(yàn),知識產(chǎn)權(quán)立法文本翻譯研究可以為我國立法機(jī)關(guān)、行政部門、企業(yè)及法學(xué)研究人員提供基礎(chǔ)性參考資料,從而促進(jìn)我國知識產(chǎn)權(quán)法律制度的完善,服務(wù)于創(chuàng)新型國家建設(shè)目標(biāo)。本報(bào)告基于英國《1988年版權(quán)、外觀設(shè)計(jì)和專利法案》英漢翻譯實(shí)踐,以紐馬克的語義翻譯和交際翻譯為理論指導(dǎo),嘗試解決知識產(chǎn)權(quán)立法文本英譯漢中的典型問題。作為法律文本的一種類型,知識產(chǎn)權(quán)立法文本包含大量法律術(shù)語、知識產(chǎn)權(quán)術(shù)語及模糊語,句型多為長難句及被動句,語篇結(jié)構(gòu)嚴(yán)謹(jǐn)、風(fēng)格莊重、邏輯嚴(yán)密。這些語言特征給翻譯工作帶來極大挑戰(zhàn),使譯者常面臨如下影響文本信息準(zhǔn)確傳遞的問題:詞匯層面,法律術(shù)語、知識產(chǎn)權(quán)術(shù)語以及模糊語翻譯準(zhǔn)確性欠佳;句法層面,長難句及被動句誤譯;篇章層面,語篇銜接不當(dāng),譯文語言風(fēng)格不統(tǒng)一。紐馬克的語義翻譯和交際翻譯理論強(qiáng)調(diào)通過語義翻譯保留原文的語境意義,以交際翻譯來優(yōu)化文本信息內(nèi)容的傳達(dá)、增強(qiáng)譯文可讀性。在紐馬克語義翻譯和交際翻譯理論的指導(dǎo)下,通過實(shí)施以下對策,可以有效解...
