多哥共和國海上貨物運(yùn)輸承運(yùn)人責(zé)任制度研究

  本文研究多哥共和國海上貨物運(yùn)輸法的承運(yùn)人責(zé)任制度。由于多哥共和國已經(jīng)批準(zhǔn)了《鹿特丹規(guī)則》,并將其納入有關(guān)海上貨物運(yùn)輸?shù)膰鴥?nèi)立法,即《新商船海運(yùn)法》中,故本文主要討論《鹿特丹規(guī)則》下的承運(yùn)人責(zé)任制度。本文介紹了多哥共和國海上貨物運(yùn)輸法從頒布批準(zhǔn)《鹿特丹規(guī)則》的發(fā)展過程,通過對《鹿特丹規(guī)則》與英國法、中國法進(jìn)行比較的方法,闡述了海上貨物運(yùn)輸承運(yùn)人的主要義務(wù)與責(zé)任。第一章是關(guān)于本文研究的—些基本問題,介紹了從研究背景、目的到包括研究方法和資料在內(nèi)的承運(yùn)人責(zé)任問題的完整體系。值得注意的是,本文的研究目的是考察多哥立法中承運(yùn)人責(zé)任制度的由來以及《鹿特丹規(guī)則》中承運(yùn)人責(zé)任制度的主要特征。本章還介紹了本文研究的主要問題,綜述了多哥文獻(xiàn)和國際文獻(xiàn)中有關(guān)海上貨物運(yùn)輸承運(yùn)人責(zé)任制度的主要觀點(diǎn)。第二章是關(guān)于多哥立法下承運(yùn)人賠償責(zé)任制度的演變。作為研究的基礎(chǔ),系統(tǒng)梳理了從多哥共和國獨(dú)立前直至批準(zhǔn)《鹿特丹規(guī)則》期間,通過和適用的有關(guān)海上運(yùn)輸?shù)膰鴥?nèi)立法,尤其是海上貨物運(yùn)輸法,即《新商船海運(yùn)法》。本章按時間順序論及了批準(zhǔn)《鹿特丹規(guī)則》之前的所有現(xiàn)行立法,并解釋了通過《新商船海運(yùn)法》時遇到的困難。第三章分析了海上貨物...
