【摘要】：以自由貿(mào)易區(qū)為主要代表的區(qū)域貿(mào)易安排近年來逐漸興起,各國(guó)都在積極談判建立自由貿(mào)易區(qū)。在自由貿(mào)易區(qū)迅速發(fā)展的同時(shí),貿(mào)易救濟(jì)措施中的保障措施制度尤為各國(guó)所重視。在界定自由貿(mào)易協(xié)定中保障措施概念的基礎(chǔ)上,明確其實(shí)施條件和類型,分析保障措施制度存在的必要性。NAFTA作為自由貿(mào)易區(qū)的典范,其中關(guān)于保障措施制度的規(guī)定較為成熟;《歐盟-加拿大自由貿(mào)易協(xié)定》和TPP中關(guān)于保障措施制度的規(guī)定也具有一定的代表性。借鑒上述自由貿(mào)易協(xié)定中保障措施制度的有益經(jīng)驗(yàn),對(duì)完善我國(guó)自由貿(mào)易協(xié)定中的保障措施制度具有重要意義。通過分析我國(guó)已簽訂的自由貿(mào)易協(xié)定中保障措施制度的現(xiàn)狀,歸結(jié)出以下主要問題:全球保障措施的適用缺乏靈活性、實(shí)施條件和實(shí)施程序不細(xì)致;雙邊保障措施過渡期限和實(shí)施期限偏長(zhǎng);爭(zhēng)端解決機(jī)制有待完善。對(duì)此,應(yīng)當(dāng)靈活運(yùn)用全球保障措施,如規(guī)定雙重貿(mào)易救濟(jì),適當(dāng)排除全球保障措施的適用,完善其實(shí)施條件和程序;細(xì)化雙邊保障措施的實(shí)施條件,適當(dāng)縮短其過渡期和實(shí)施期限;建立預(yù)警機(jī)制,完善爭(zhēng)端解決機(jī)制和救濟(jì)手段。
[Abstract]:The regional trade arrangement, mainly represented by the free trade area, is rising gradually in recent years, and all countries are negotiating actively to establish the free trade area. With the rapid development of free trade zone, the system of safeguard measures in trade relief measures is paid more attention by many countries. On the basis of defining the concept of safeguard measures in free trade agreements, this paper clarifies its implementation conditions and types, and analyzes the necessity of the existence of safeguard measures. NAFTA is the model of free trade area. The provisions of the safeguards system are mature, and the provisions of the EU-Canada Free Trade Agreement and the TPP are also representative. It is of great significance to perfect the safeguard measures system in China's free trade agreements by drawing on the beneficial experience of the safeguard measures system in the above free trade agreements. By analyzing the current situation of the safeguard measures system in the free trade agreements signed by China, the main problems are summarized as follows: the application of global safeguard measures lacks flexibility, the implementation conditions and procedures are not detailed; The transitional period and implementation period of bilateral safeguard measures are too long, and the dispute settlement mechanism needs to be improved. In this regard, global safeguard measures should be applied flexibly, such as the provision of double trade relief, the appropriate exclusion of the application of global safeguard measures, the improvement of their implementation conditions and procedures, and the refinement of the implementation conditions of bilateral safeguards, It should shorten the transition period and implement time appropriately, establish early warning mechanism, perfect dispute settlement mechanism and relief means.
