【摘要】：自我國實(shí)行改革開放以來,公民社會(huì)不斷成熟,各種利益群體和社會(huì)階層逐步形成,而隨著公民意識(shí)、民主意識(shí)的不斷覺醒,我國民主法制建設(shè)不斷完善,公眾民主意識(shí)和政治參與熱情日漸提高。當(dāng)前,我國正處于經(jīng)濟(jì)轉(zhuǎn)軌、社會(huì)轉(zhuǎn)型期,社會(huì)矛盾突出,人大代表作為我國國家權(quán)力機(jī)關(guān)的組成人員,在參與管理國家和社會(huì)事務(wù),維護(hù)人民群眾的根本利益方面發(fā)揮著重要作用。在此同時(shí),我們也看到,一些代表缺乏履職意識(shí)和代表缺乏依法履職的必要保障,在履職的時(shí)間、經(jīng)費(fèi)等方面存在一些困難等。這些情況的出現(xiàn),在一定程度上影響了代表更好地履職,制約了代表作用的發(fā)揮,必須引起高度重視,認(rèn)真研究加以解決。因此,對(duì)地方人大代表履職中存在的問題和對(duì)策研究就顯得十分迫切和必要。針對(duì)地方人大代表履職中存在的問題,本文以H市人大代表實(shí)際履職情況為例,通過對(duì)H市人大代表履職情況的調(diào)研,運(yùn)用代表理論,對(duì)比法律規(guī)定的人大代表的權(quán)利義務(wù),分析地方人大代表履職過程中存在的現(xiàn)實(shí)問題。首先,研究了地方人大代表履職過程中存在的問題,研究認(rèn)為,H市人大代表存在代表履職意識(shí)不強(qiáng),代表履職能力不足和代表活動(dòng)形式化、代表建議質(zhì)量不高、代表監(jiān)督效果弱化的問題。其次,研究分析存在問題的原因,地方人大代表履職情況與實(shí)際職權(quán)的差距,既有個(gè)人的主觀認(rèn)識(shí)原因,也是客觀的履職環(huán)境原因。主要概況有,對(duì)代表的話語權(quán)重視不夠,代表結(jié)構(gòu)不合理,兼職代表制缺陷,代表的保障制度不完善和監(jiān)督機(jī)制不健全。最后,文章提出了提高地方人大代表履職能力的建議,即促進(jìn)人大代表履職盡責(zé),要加大宣傳力度,營(yíng)造履職氛圍;加強(qiáng)代表培訓(xùn),提高履職能力;優(yōu)化代表結(jié)構(gòu),打牢履職基礎(chǔ);強(qiáng)化保障措施,創(chuàng)造履職條件;完善監(jiān)督機(jī)制,激發(fā)履職動(dòng)力。從而使人大代表更好地依法履職行權(quán),使人民代表大會(huì)制度不斷創(chuàng)新發(fā)展。
[Abstract]:Since the implementation of reform and opening up in China, civil society has matured, various interest groups and social strata have gradually formed, and with the constant awakening of civic consciousness and democratic consciousness, the construction of democratic legal system in China has been continuously improved. The public's democratic consciousness and enthusiasm for political participation are increasing day by day. At present, our country is in the process of economic transition, social transition period, and social contradictions are prominent. As members of our state power organs, deputies to the National people's Congress are participating in the management of state and social affairs. Safeguarding the fundamental interests of the people is playing an important role. At the same time, we also see that some delegates lack the awareness of performing their duties and the necessary guarantees for them to carry out their duties according to law, and there are some difficulties in performing their duties in terms of their time and funds. To a certain extent, the emergence of these situations has affected the representative to perform his duties better and restricted the role of the representative, which must be paid close attention to and solved seriously. Therefore, it is very urgent and necessary to study the problems and countermeasures of the local people's Congress deputies. In view of the problems existing in the performance of the duties of the deputies to the local people's Congress, this paper takes the actual performance of the duties of the deputies to the people's Congress of H City as an example, through the investigation and investigation of the performance of the duties of the deputies to the people's Congress of the City of H, and applies the representative theory to compare the rights and obligations of the deputies to the people's congresses This paper analyzes the practical problems existing in the process of the local people's Congress deputies performing their duties. First of all, the paper studies the problems existing in the process of carrying out the duties of the local people's Congress deputies. It is concluded that the deputies to the people's Congress in Hou H City do not have strong consciousness of performing their duties, lack of ability to carry out their duties and formalization of the representative activities, and the quality of the deputies' suggestions is not high. On behalf of the weakening of the supervision effect. Secondly, research and analysis of the reasons for the problems, the gap between the local people's Congress deputies and the actual functions and powers, both personal subjective understanding reasons, but also objective environmental reasons for carrying out their duties. The main general situation is that the representative's right of speech is not paid enough attention to, the representative structure is unreasonable, the part-time representative system is defective, the representative's security system is not perfect and the supervision mechanism is not perfect. Finally, the paper puts forward some suggestions to improve the ability of local people's Congress deputies to perform their duties, that is, to promote the people's Congress deputies to exercise their duties with due diligence, to step up publicity efforts, to create an atmosphere for carrying out their duties, to strengthen the training of deputies, to improve their ability to carry out their duties, and to optimize the representative structure. Strengthen the safeguard measures, create the conditions for carrying out duties, perfect the supervision mechanism, and stimulate the motivation of carrying out one's duties. Thus, deputies to the people's Congress can perform their duties according to law and make the system of people's congresses keep innovating and developing.
