【摘要】：2016年6月國務(wù)院出臺的《關(guān)于在市場體系建設(shè)中建立公平競爭審查制度的意見》確立了我國實(shí)行公平競爭審查制度,并且明確規(guī)定了公平競爭審查的審查主體、審查方式、審查標(biāo)準(zhǔn)等內(nèi)容,為我國政策措施公平競爭審查的開展確立了基礎(chǔ)的框架。公平競爭審查制度是確立我國競爭政策基礎(chǔ)性地位的重要制度,它的實(shí)施對于深入推進(jìn)經(jīng)濟(jì)體制改革,釋放市場主體活力具有重要作用。本文探討了公平競爭審查制度的具體適用,并且結(jié)合了我國的電信行業(yè)增量政策措施和存量政策措施的具體情況,試圖探討公平競爭審查制度在我國電信業(yè)的適用,并且結(jié)合域外公平競爭審查實(shí)施的具體經(jīng)驗(yàn),探討我國公平競爭審查制度可能存在的不足和具體的改進(jìn)建議,以期在未來制定公平競爭審查制度實(shí)施細(xì)則和競爭評估清單時可以提供一些參考。本文共包含四部分內(nèi)容,第一部分介紹了我國公平競爭審查制度的特點(diǎn),我國電信業(yè)的現(xiàn)狀和電信業(yè)適用公平競爭審查制度的必要性與緊迫性。此部分旨在為后文的論述打下基礎(chǔ)。第二部分論述了我國電信業(yè)增量政策措施的公平競爭審查適用,從審查依據(jù)、審查主體、審查對象、審查標(biāo)準(zhǔn)、審查程序五個方面,結(jié)合我國的規(guī)定和域外經(jīng)驗(yàn)的借鑒進(jìn)行了論述,并且提出了適用完善的建議。第三部分對我國電信業(yè)存量政策措施的公平競爭審查適用進(jìn)行了論述,闡明了我國電信業(yè)存量政策措施的現(xiàn)狀,并結(jié)合《中華人民共和國電信條例》、《外商投資電信企業(yè)管理規(guī)定》的適用進(jìn)行了論述。第四部分對我國電信業(yè)適用公平競爭審查制度的實(shí)施保障進(jìn)行了說明,包括發(fā)揮競爭主管機(jī)構(gòu)的指導(dǎo)作用、發(fā)揮反壟斷執(zhí)法的保障作用、完善公平競爭審查的第三方評估機(jī)制、建立對于政策措施的定期評估機(jī)制、完善社會監(jiān)督與責(zé)任追究機(jī)制五個方面。
[Abstract]:In June 2016, the State Council's opinions on establishing a fair competition review system in the construction of the market system established the fair competition review system in China, and clearly defined the subject and mode of the fair competition review. The review standard and other contents establish the basic framework for the fair competition examination of policy and measures in China. The fair competition examination system is an important system to establish the basic position of our country's competition policy. Its implementation plays an important role in promoting the reform of the economic system and releasing the vitality of the main body of the market. This paper discusses the application of fair competition review system, and combines the increment policy measures and stock policy measures of China's telecommunications industry, attempts to explore the application of fair competition review system in China's telecommunications industry. And combined with the specific experience of the implementation of the extraterritorial fair competition review, this paper discusses the possible shortcomings and specific suggestions for improvement of the fair competition review system in China. The aim is to provide some reference for the future development of the implementation rules of the fair competition review system and the competition assessment checklist. The first part introduces the characteristics of China's fair competition review system, the current situation of China's telecommunications industry and the necessity and urgency of applying fair competition review system. The purpose of this part is to lay the foundation for the later discussion. The second part discusses the application of fair competition review of incremental policy measures in China's telecommunications industry, from five aspects: the basis of the review, the subject, the object, the standard and the procedure of the review. This paper discusses the regulations of our country and the experience of foreign countries, and puts forward some suggestions for perfection. In the third part, the author discusses the application of fair competition review on the stock policy and measures of China's telecom industry, and expounds the present situation of the policy measures on the stock of telecommunications industry in China. It also discusses the application of the regulations of the people's Republic of China and the regulations on the Administration of Foreign Investment Telecommunications Enterprises. The fourth part describes the implementation of fair competition review system in China's telecommunications industry, including giving full play to the role of competition authorities, playing the role of protection of anti-monopoly law enforcement, and improving the third party evaluation mechanism of fair competition review. Establish regular evaluation mechanism for policy measures, perfect social supervision and accountability mechanism.
