【摘要】:移動(dòng)互聯(lián)網(wǎng)技術(shù)的不斷進(jìn)步推動(dòng)了共享經(jīng)濟(jì)的蓬勃發(fā)展,"互聯(lián)網(wǎng)+"這一嶄新的商業(yè)創(chuàng)新模式,正在不斷的與社會(huì)各個(gè)行業(yè)融合,網(wǎng)約車就是在此時(shí)代背景下的產(chǎn)物。幾年間,網(wǎng)約車服務(wù)迅猛發(fā)展,面對(duì)打車難的現(xiàn)狀,網(wǎng)約車的出現(xiàn)無(wú)疑極大的方便了市民的出行,在共享經(jīng)濟(jì)理論下起到了市場(chǎng)化配置資源的作用。但與此同時(shí),網(wǎng)約車服務(wù)也產(chǎn)生了諸多問(wèn)題,目前的監(jiān)管制度又有其缺陷,加之執(zhí)行不力,導(dǎo)致網(wǎng)約車行業(yè)市場(chǎng)混亂,制度化監(jiān)管仍任重道遠(yuǎn)。因此,筆者通過(guò)分析當(dāng)前網(wǎng)約車行業(yè)的現(xiàn)狀與問(wèn)題,在借鑒國(guó)外經(jīng)驗(yàn)的基礎(chǔ)上結(jié)合本國(guó)實(shí)際,為網(wǎng)約車行業(yè)監(jiān)管制度提供優(yōu)化建議,以便能夠更好的規(guī)范網(wǎng)約車行業(yè)的整體發(fā)展環(huán)境,從而形成社會(huì)、行業(yè)與個(gè)人的"多贏"局面。本文正文分為四個(gè)部分:第一部分是網(wǎng)約車運(yùn)營(yíng)基礎(chǔ)理論分析,該部分對(duì)網(wǎng)約車做出概念界定,對(duì)其產(chǎn)生的背景進(jìn)行概括,闡明其在現(xiàn)代社會(huì)存在的必要性與必然性,同時(shí)梳理了網(wǎng)約車國(guó)內(nèi)發(fā)展歷程,在此基礎(chǔ)上分析其所面臨的各種問(wèn)題,為下文監(jiān)管制度的提出與完善奠定基礎(chǔ)。第二部分是對(duì)網(wǎng)約車監(jiān)管現(xiàn)狀的比較分析,主要介紹了域外幾個(gè)具有代表性的國(guó)家網(wǎng)約車監(jiān)管經(jīng)驗(yàn),包括美國(guó)的創(chuàng)新模式、英國(guó)的雙軌制構(gòu)架、新加坡寬松的監(jiān)管模式以及以法國(guó)和韓國(guó)為代表的嚴(yán)格禁止模式,并對(duì)其進(jìn)行評(píng)析,以便為我國(guó)提供借鑒。第三部分是對(duì)網(wǎng)約車監(jiān)管路徑的探析,首先對(duì)監(jiān)管的基礎(chǔ)理論進(jìn)行分析,其次對(duì)監(jiān)管的方式、對(duì)象和適度性進(jìn)行分析、最后是對(duì)監(jiān)管模式的選擇,從而為網(wǎng)約車監(jiān)管路徑指明方向。第四部分是對(duì)網(wǎng)約車監(jiān)管制度提出的優(yōu)化建議,主要包括完善現(xiàn)存的網(wǎng)約車行業(yè)法規(guī)、建立體系化監(jiān)管機(jī)制、加強(qiáng)網(wǎng)約車平臺(tái)制度建設(shè)等,從而形成一套體系化的制度,為我國(guó)網(wǎng)約車行業(yè)持續(xù)發(fā)展提供制度依托,并促進(jìn)其健康有序發(fā)展。
[Abstract]:The continuous progress of mobile Internet technology has promoted the vigorous development of the sharing economy. The "Internet", a brand new business innovation mode, is constantly merging with all sectors of society, and car-sharing is the product of this era. In recent years, the rapid development of the network ride-sharing service, in the face of the current situation of taxi difficulties, the emergence of net-ride-sharing undoubtedly greatly facilitated the travel of citizens, and played the role of market-oriented allocation of resources under the theory of shared economy. However, at the same time, there are many problems in the ride-hailing service, and the current regulatory system has its defects, together with the weak implementation, resulting in the market chaos of the net-ride-hailing industry, and the institutionalized supervision still has a long way to go. Therefore, through the analysis of the current situation and problems of the network ride-hailing industry, and on the basis of drawing lessons from the experience of foreign countries, combining with the reality of our country, the author provides some suggestions for optimizing the regulation system of the net-ride-hailing industry. In order to better regulate the overall development environment of the car-sharing industry, thus forming the society, industry and individual "win" situation. The main body of this paper is divided into four parts: the first part is the basic theory analysis of the net-chartered car operation, this part defines the concept of the net-chartered car, generalizes its background, and clarifies the necessity and inevitability of its existence in the modern society. At the same time, it combs the history of domestic development, analyzes the problems it faces, and lays a foundation for the establishment and perfection of the following regulatory system. The second part is the comparative analysis of the current situation of the regulation of net-chartered cars. It mainly introduces the experiences of several representative countries in foreign countries, including the innovative mode of the United States, the two-track system framework of the United Kingdom. Singapore's loose regulatory model and the strict prohibition model represented by France and South Korea are reviewed in order to provide reference for our country. The third part is the analysis of the route of regulation, first of all, the basic theory of regulation, secondly, the mode, object and appropriateness of supervision, and finally, the choice of supervision mode. As a result of the network car regulatory path to point out the direction. The fourth part is the optimization of the regulation system, including the improvement of the existing regulations, the establishment of a systematic regulatory mechanism, the strengthening of the construction of the system of ride-hailing platform, so as to form a systematic system. It provides system support for the sustainable development of China's ride-hailing industry and promotes its healthy and orderly development.
