【摘要】：隨著成功“入世”和知識(shí)經(jīng)濟(jì)時(shí)代的來臨,我國(guó)對(duì)知識(shí)產(chǎn)權(quán)的重視程度相應(yīng)加大。藥品領(lǐng)域的知識(shí)產(chǎn)權(quán)保護(hù)問題受到越來越多的關(guān)注。藥品生產(chǎn)企業(yè)的蓬勃崛起離不開藥品的信息保護(hù)。我國(guó)對(duì)藥品信息保護(hù)問題規(guī)定的相關(guān)法律法規(guī)還不健全。將關(guān)系公眾生命健康的知情權(quán)納入商業(yè)秘密研究范疇,不僅有利于保護(hù)公共健康,還有利于后續(xù)創(chuàng)新的維持。在追求藥品產(chǎn)業(yè)化的同時(shí)如何從權(quán)利角度分析藥品的信息保護(hù)問題,對(duì)于保護(hù)公眾的知情權(quán)以及協(xié)調(diào)商業(yè)秘密權(quán)和知情權(quán)之間的沖突,具有一定的研究前景。筆者從權(quán)利保護(hù)角度出發(fā),厘清藥品信息的概念及特征,整理出問題的表現(xiàn)。著重研究信息的保密與公開問題,找到問題沖突背后的原因,基于此提出協(xié)調(diào)沖突的建議。本文從四個(gè)方面對(duì)這個(gè)問題進(jìn)行分析:第一個(gè)部分從理論概念出發(fā),厘清藥品信息的內(nèi)涵、外延及特征,對(duì)需要保護(hù)的藥品信息范疇進(jìn)行認(rèn)定;第二部分列舉了我國(guó)藥品信息保護(hù)現(xiàn)狀及存在的問題;第三部分對(duì)我國(guó)藥品信息保護(hù)存在的問題進(jìn)行原因分析;第四部分作為主要章節(jié),對(duì)完善我國(guó)藥品信息保護(hù)提出幾點(diǎn)建議。
[Abstract]:With the successful entry into WTO and the coming of knowledge economy era, our country pays more attention to intellectual property. More and more attention has been paid to the protection of intellectual property in the field of medicine. The vigorous rise of pharmaceutical manufacturing enterprises can not be separated from the information protection of drugs. The relevant laws and regulations on the protection of drug information in our country are not perfect. It is not only beneficial to protect public health but also conducive to the maintenance of subsequent innovation to bring the right to know about public life and health into the scope of research on trade secrets. How to analyze the protection of drug information from the angle of right while pursuing the industrialization of drugs has a certain research prospect for protecting the public's right to know and coordinating the conflict between the right to know and the right to know. From the perspective of right protection, the author clarifies the concept and characteristics of drug information and sorts out the problems. This paper focuses on the confidentiality and disclosure of information, finds out the reasons behind the conflict, and puts forward some suggestions to coordinate the conflict. This paper analyzes this problem from four aspects: the first part is to clarify the connotation, extension and characteristics of drug information from the theoretical concept, and to identify the categories of drug information that need to be protected; The second part lists the current situation and existing problems of drug information protection in China; the third part analyzes the causes of the problems existing in the protection of drug information in China; the fourth part as the main chapter, Some suggestions are put forward to improve the protection of drug information in China.
