【摘要】：文章以《湖北天門熊氏契約文書》一書中的田地租佃契約文書為研究對象,運用統(tǒng)計歸納的方法、史學的方法以及法學的方法對清代湖北天門熊氏家族的田地租佃契約的相關內容進行了研究。分析了熊氏田地租佃契約文書與經濟關系、社會關系之間的聯(lián)系。在行文結構上,文章共分為四章。第一章為緒論部分,主要論述了選題意義、文獻綜述以及主要的研究內容和研究方法,較為系統(tǒng)的介紹了契約研究的現(xiàn)狀,并著重介紹了關于《湖北天門熊氏契約文書》一書的研究成果。第二章為熊氏田地租佃契約文書概述部分,主要介紹了熊氏田地租佃契約文書在時間分布上的特性、熊氏田地租佃契約文書中相關的地租類型以及熊氏田地租佃契約文書在格式和內容上所具有的時代特性和地域特性。第三章則是對熊氏田地租佃契約構成要件的研究,以現(xiàn)代租賃合同的相關理論為基礎,主要分析了包括立約當事人、契約標的物、地租與佃價、租佃期限、租佃契約的效力、違約責任以及憑保人等在內的具體內容。在最后一章中——第四章——則主要考察了熊氏田地租佃契約文書所體現(xiàn)出的清代契約習慣、清代制定法對租佃契約內容的相關規(guī)定以及熊氏田地租佃契約與現(xiàn)代租賃合同之間的異同等內容。從熊氏田地租佃契約文書的研究中可以揭示出社會環(huán)境對田主與佃戶階級關系的影響,發(fā)現(xiàn)熊氏田地租佃契約文書的特性、局部地區(qū)的契約習慣與整個社會的契約習慣之間的聯(lián)系以及契約習慣在后世的傳承與影響。
[Abstract]:The paper takes the land tenancy contract document in Hubei Tianmen Xiong's contract document as the research object, and applies the method of statistical induction. The methods of historiography and the method of law have studied the relevant contents of the land tenancy contract of Xiong family in Hubei Province in Qing Dynasty, analyzed the relationship between Xiong's land tenancy documents and economic relations and social relations. The article is divided into four chapters. The first chapter is the introduction, mainly discusses the significance of the topic, literature review, the main research content and research methods, more systematic introduction of the current situation of contract research. The second chapter is an overview of Xiong's land tenancy documents, which mainly introduces the characteristics of Xiong's land tenancy documents in time distribution. The relevant land rent types in Xiong's land tenancy documents and the age and geographical characteristics of Xiong's land tenancy documents in format and content. Chapter three is a study of the constituent elements of Xiong's land tenancy contracts. Based on the relevant theories of modern lease contract, this paper mainly analyzes the parties to the contract, the subject matter of the contract, the land rent and tenancy price, the term of tenancy, the validity of the tenancy contract. In the last chapter-4th chapter-mainly examines the Qing Dynasty contract habits embodied in Xiong's land tenancy contract documents. The relevant provisions of the constitution law of Qing Dynasty on the content of tenancy contract and the similarities and differences between Xiong's land tenancy contract and modern lease contract, etc. From the study of Xiong's land tenancy contract document, it can be revealed that the social environment has great influence on the owner of the land. The influence of class relations with tenants, The paper finds out the characteristics of Xiong's land tenancy documents, the relationship between local contract habits and the whole society's contract habits, and the inheritance and influence of contract habits in later generations.
