【摘要】：本文主要以法律層面上的國(guó)際反恐合作機(jī)制的建構(gòu)與完善問題研究為主。二十世紀(jì)以來恐怖主義活動(dòng)不減反增,借由新技術(shù)發(fā)展滋生出更多形式的恐怖主義。國(guó)際恐怖主義影響不斷擴(kuò)大,嚴(yán)重傷害無辜公民的生命和安全、危害主權(quán)國(guó)家的社會(huì)經(jīng)濟(jì)發(fā)展,破壞全球穩(wěn)定與繁榮。在當(dāng)前恐怖主義活動(dòng)全球化的背景下,國(guó)際社會(huì)日益重視在反恐領(lǐng)域進(jìn)行國(guó)際合作,不斷嘗試從全球治理角度徹底解決恐怖主義問題。在法律規(guī)制下系統(tǒng)性防治恐怖主義的國(guó)際合作機(jī)制的構(gòu)建成為應(yīng)對(duì)恐怖主義的重要方式。聯(lián)合國(guó)倡導(dǎo)各國(guó)加強(qiáng)合作共同抵御和打擊恐怖活動(dòng),通過制訂公約明確恐怖主義犯罪,通過立法制裁恐怖行動(dòng)已然成為國(guó)際社會(huì)之共識(shí)。國(guó)際反恐合作機(jī)制的運(yùn)行有賴于一套嚴(yán)格的法律體系來有效規(guī)制。有效建立與完善改法律機(jī)制是反恐合作最終取得勝利的重要保障。各國(guó)嚴(yán)格遵守國(guó)際法基本原則與《聯(lián)合國(guó)憲章》精神,乃有效完善合作機(jī)制的法律基石。本文通過對(duì)國(guó)際反恐法律合作現(xiàn)狀的概述,聯(lián)合國(guó)法律框架內(nèi)的反恐實(shí)踐以及存在的問題,區(qū)域反恐實(shí)踐取得的成績(jī)以及存在的問題等進(jìn)行闡述,全面分析國(guó)際反恐合作機(jī)制存在的法律問題,試圖從立法等方面尋求完善的措施。國(guó)際反恐合作前路漫漫,只有在主權(quán)平等的基礎(chǔ)上有效增進(jìn)不同文明之間的理解,倡導(dǎo)聯(lián)合國(guó)法律框架下建立反恐合作機(jī)制,摒棄戰(zhàn)爭(zhēng)方式,通過全球綜合治理真正消弭歷史的仇恨和內(nèi)心的痛苦,從根源上鏟除恐怖主義。
[Abstract]:This paper mainly focuses on the legal aspects of the construction and improvement of international counter-terrorism cooperation mechanism. Since 20th century, terrorist activities have not decreased but increased. Through the development of new technologies, more forms of terrorism have spawned. The impact of international terrorism is constantly expanding, seriously harming the lives and security of innocent citizens and endangering the socio-economic development of sovereign States. Against the backdrop of the current globalization of terrorist activities, the international community has increasingly attached importance to international cooperation in the field of counter-terrorism. The international cooperation mechanism of systematic prevention and control of terrorism under legal regulation has become an important way to deal with terrorism. The United Nations advocates that countries should strengthen the system of prevention and control of terrorism. To cooperate in combating and combating terrorist activities. The definition of terrorist offences through the elaboration of conventions. It has become a consensus of the international community to sanction terrorist actions through legislation. The operation of international anti-terrorism cooperation mechanism depends on a set of strict legal system to effectively regulate. Effective establishment and improvement of the legal mechanism is the ultimate anti-terrorism cooperation. All countries strictly abide by the basic principles of international law and the spirit of the Charter of the United Nations. It is the legal cornerstone of the effective improvement of the mechanism of cooperation. This paper summarizes the current situation of international legal cooperation against terrorism, the legal framework of the United Nations counter-terrorism practice and existing problems. The achievements and problems of regional counter-terrorism practice are expounded, and the legal problems of international anti-terrorism cooperation mechanism are comprehensively analyzed. Trying to seek perfect measures from legislation and other aspects. International anti-terrorism cooperation has a long way to go, only on the basis of sovereign equality to effectively promote understanding among different civilizations. We advocate the establishment of a mechanism for anti-terrorism cooperation under the legal framework of the United Nations, abandon the way of war, truly eliminate historical hatred and inner pain through comprehensive global governance, and eradicate terrorism from its root causes.
