【摘要】：隨著我國(guó)《反家庭暴力法》的正式頒布,家庭暴力犯罪得到越來(lái)越多的關(guān)注和重視。國(guó)家、社會(huì)以及普通民眾都希望藉由該部反家庭暴力領(lǐng)域?qū)ｉT(mén)法律的實(shí)施,對(duì)我國(guó)目前家庭暴力犯罪案件多發(fā)、危害后果嚴(yán)重的態(tài)勢(shì)得以遏制,給家庭暴力犯罪的受害者尤其受害婦女給予法治的關(guān)懷和保障。但是,目前在我國(guó)家庭暴力犯罪領(lǐng)域,還面臨很多難題與困境,而這種局面又集中于證據(jù)方面顯現(xiàn)出來(lái)�？墒恰斗醇彝ケ┝Ψā凡](méi)有對(duì)家庭暴力犯罪的證據(jù)制度作出特殊規(guī)定,因此,現(xiàn)階段家庭暴力犯罪的認(rèn)定還是依照傳統(tǒng)刑事訴訟法關(guān)于證據(jù)制度的基本規(guī)定,這也必然導(dǎo)致家庭暴力犯罪案件司法認(rèn)定的困局。因此,本文擬在借鑒和學(xué)習(xí)域外關(guān)于家庭暴力犯罪證據(jù)制度的法律經(jīng)驗(yàn)前提下,結(jié)合國(guó)內(nèi)學(xué)者現(xiàn)有關(guān)于家庭暴力犯罪證據(jù)制度的有益成果,提出合理化的對(duì)策與建議。論文主體分為五個(gè)部分。第一部分是關(guān)于家庭暴力犯罪的概述,首先對(duì)家庭暴力的基本內(nèi)涵進(jìn)行分析,主要從主體類型和行為方式兩個(gè)角度展開(kāi);其次再對(duì)家庭暴力犯罪的構(gòu)成要件進(jìn)行梳理和闡述。第二部分是對(duì)影響家庭暴力犯罪的因素進(jìn)行基本的介紹和分析,包括個(gè)體因素、家庭結(jié)構(gòu)因素、經(jīng)濟(jì)因素、文化環(huán)境因素、社會(huì)控制因素等五個(gè)方面。第三部分對(duì)我國(guó)目前家庭暴力犯罪證據(jù)方面的困局展開(kāi)深入分析,通過(guò)對(duì)免證特權(quán)問(wèn)題、證據(jù)種類問(wèn)題、證明主體問(wèn)題、證明責(zé)任問(wèn)題四個(gè)方面的剖析,從而形成對(duì)我國(guó)目前家庭暴力犯罪的證據(jù)制度問(wèn)題的基本概覽。第四部分介紹域外在家庭暴力犯罪證據(jù)制度方面的法律治理經(jīng)驗(yàn),主要是對(duì)美國(guó)、英國(guó)和臺(tái)灣三個(gè)國(guó)家或地區(qū)進(jìn)行介紹分析。第五部分提出完善我國(guó)家庭暴力證據(jù)制度的建議,以期為我國(guó)解決家庭暴力犯罪證據(jù)方面的困局提供有益的參考和借鑒。
[Abstract]:With the promulgation of the domestic violence Law in China, more and more attention has been paid to the crime of domestic violence. The country, society and ordinary people hope to use the special law in the field of anti-domestic violence to implement. To our country present domestic violence crime case frequency, the harm consequence serious situation to be able to contain, to the domestic violence crime victim especially the victim woman gives the rule of law care and the safeguard. At present, there are still many difficulties and difficulties in the field of domestic violence crime in China. However, the domestic violence Act does not have special provisions on the system of evidence for domestic violence crimes, therefore. At present, the identification of domestic violence crime is still in accordance with the basic provisions of the evidence system of the traditional criminal procedure law, which will inevitably lead to the difficulties of judicial determination of domestic violence crime cases. This paper intends to learn from and learn from the extraterritorial evidence system of domestic violence on the premise of the evidence system, combined with domestic scholars on the domestic violence evidence system on the evidence of domestic violence system of beneficial results. The main body of the paper is divided into five parts. The first part is an overview of the crime of domestic violence, first of all, the basic connotation of domestic violence is analyzed. Mainly from two angles of subject type and behavior mode; The second part is the basic introduction and analysis of the factors affecting the crime of domestic violence, including individual factors, family structure factors, economic factors. The third part deeply analyzes the difficulties of the evidence of domestic violence in our country, through the privilege of exemption, the type of evidence. The analysis of four aspects of the problem of the main body of proof and the problem of burden of proof. Thus form a basic overview of the evidence system of domestic violence crime in China. Part 4th introduces the extraterritorial legal governance experience in domestic violence crime evidence system, mainly to the United States. Introduction and analysis of three countries or regions in Britain and Taiwan. Part 5th puts forward suggestions to improve the evidence system of domestic violence in China. In order to solve the domestic violence evidence for our country to provide a useful reference and reference.
