【摘要】：法律語篇文本是承載法律意義、信息,貫徹法律意志的語篇文本,具有有別于其他文本類型的特點。漢英法律語篇文本翻譯是法律意義、信息在漢英語符上的轉換。法律語篇文本翻譯是國際間交往、完善自身法律體系不可或缺的重要手段,是國際間的交往的法律規(guī)范準繩。漢英法律語篇文本翻譯是漢英兩種語言在語言符號上的轉換,是各種差異都摻雜其中復雜的活動,這些差異表現于兩種語言符號及其內部因素和所涉及的文化、社會、思維等因素及其關系之中,導致法律語篇文本翻譯復雜而難以操作,引發(fā)許多法律語篇文本翻譯的理論和實踐問題。為解決漢英法律語篇翻譯中的問題,進一步促進法律翻譯的理論體系和實踐的發(fā)展,本文旨在以翻譯理論和語篇文本理論為基礎,以漢英法律翻譯文本為語料,以字詞、句式、篇章等為視角,分析研究漢英語言在法律語篇文本上的特點,分析研究影響漢英法律語篇文本翻譯的文化、社會、思維等因素及影響機制,探索法律語篇文本翻譯的原則和策略,從理論和實踐兩個方面揭示漢英法律語篇文本翻譯中的潛在規(guī)律,為法律語篇文本翻譯提供理論和實踐參考,以期促進英漢法律語言翻譯理論與實踐研究。全文共分緒論、主體和結論三個部分。緒論部分為第一章。本章闡述了本選題的原因、研究思路、研究的目的、意義和研究方法。主體部分由第二章到第七章構成。第二章闡述翻譯和法律翻譯的歷史、問題以及影響法律翻譯的因素。在影響因素中,主要針對漢英語符構成和漢英思維差異進行探討。第三章是本研究的理論基礎部分,主要討論翻譯理論、學說和觀點,為法律語篇文本翻譯研究奠定基礎。其中的功能對等翻譯理論、系統(tǒng)功能理論和關聯(lián)理論作為法律語篇文本翻譯各方面的研究的主要理論基礎。同時,對中國經典翻譯觀點進行了討論。本章還對影響法律語篇文本翻譯的各種因素的分析,特別是在文化、思維等方面進行了較深的探討。第四章到第七章為法律語篇文本在詞語、句式和篇章特點以及法律語篇文本翻譯的原則和策略研究的主體部分。通過案例分析,主要討論了在漢英兩種語言在詞語、句式和篇章上的差異以及差異的原因的分析和研究。詞匯上,提出了“日常詞匯法律固化”、“法律詞匯日�；罨薄⒅阜Q與所指、概念與含義等現象和概念;提出了漢語語句成分順序的演繹—歸納和英語的歸納—演繹句式特點等。第七章提出了法律語篇文本翻譯原則和策略。在對漢英法律語言差異研究的基礎上,探索了忠實、準確、簡明、同一、去情性和謹慎創(chuàng)造性的原則;研究了直譯與意譯、歸化與異化、拆譯與釋譯和長句像似性翻譯等法律語篇文本翻譯的策略。結論部分為第八章。本章主要對本論文的觀點進行歸納和總結,陳述研究中存在的不足,并就未來的研究提出設想。
[Abstract]:Legal text is a text with legal meaning, information and legal will, which is different from other text types. Chinese-English legal text translation is the translation of legal meaning and information in Chinese and English. Legal text translation is an indispensable means of international communication and perfection of its own legal system. It is also the criterion of international communication. The translation of Chinese-English legal texts is the transformation between Chinese and English on the linguistic symbols. It is a complex activity in which all kinds of differences are mixed. These differences are manifested in the two language symbols and their internal factors and the culture and society involved. Among the factors such as thinking and its relationship, legal text translation is complicated and difficult to operate, which leads to many theoretical and practical problems in legal text translation. In order to solve the problems in Chinese-English legal text translation and further promote the development of legal translation theory and practice, this paper aims at taking the translation theory and text theory as the basis, the Chinese-English legal translation text as the corpus, and the word and sentence structure. From the perspective of text, this paper analyzes the characteristics of the Chinese-English language in legal texts, and analyzes the cultural, social and ideological factors that affect the translation of legal texts in Chinese-English legal texts, as well as their influencing mechanisms. This paper explores the principles and strategies of legal text translation, reveals the potential rules in Chinese-English legal text translation from both theoretical and practical aspects, and provides theoretical and practical references for legal text translation. In order to promote the translation of English and Chinese legal language theory and practice. The full text is divided into three parts: introduction, subject and conclusion. The introduction part is the first chapter. This chapter describes the reasons, research ideas, research purposes, significance and research methods. The main part consists of Chapter 2 to Chapter 7. Chapter two deals with the history, problems and factors of legal translation. Among the influencing factors, this paper mainly discusses the differences between Chinese and English characters and the differences of Chinese and English thinking. Chapter three is the theoretical basis of this study, which mainly discusses translation theories, theories and viewpoints, and lays a foundation for the study of legal text translation. The functional equivalence translation theory, the systemic functional theory and the relevance theory are the main theoretical bases for the study of legal text translation. At the same time, the views of Chinese classic translation are discussed. This chapter also analyzes the factors that affect the translation of legal texts, especially in the aspects of culture and thinking. The fourth to seventh chapters are the main part of the study on the principles and strategies of legal text translation in terms of words, sentence patterns and textual features. Through case study, this paper mainly discusses the differences between Chinese and English in terms of words, sentence patterns and texts and the reasons for the differences. In terms of vocabulary, this paper puts forward the phenomena and concepts of "legal solidification of daily vocabulary", "daily activation of legal vocabulary", reference and reference, concept and meaning, etc. The characteristics of deductive-inductive sentence order and inductive-deductive sentence structure in English are put forward. Chapter seven puts forward the principles and strategies of legal text translation. On the basis of the study of the differences between Chinese and English legal languages, this paper explores the principles of faithfulness, accuracy, conciseness, uniformity, deaffection and discreet creativity, and studies literal and free translation, domestication and alienation. The translation strategies of legal texts such as translation and interpretation and long sentence iconicity translation. The conclusion is chapter 8. This chapter summarizes and summarizes the viewpoints of this paper, states the shortcomings of the research, and puts forward some ideas for the future research.
