鄂爾多斯地區(qū)政府環(huán)境監(jiān)管問(wèn)題研究

【摘要】:"十三五"時(shí)期,環(huán)境保護(hù)和生態(tài)文明建設(shè)都進(jìn)入新常態(tài),經(jīng)濟(jì)發(fā)展呈現(xiàn)出高速增長(zhǎng)的態(tài)勢(shì),而伴隨著經(jīng)濟(jì)的增長(zhǎng),資源環(huán)境狀況卻急劇惡化,并且環(huán)境容量和資源消耗強(qiáng)度對(duì)經(jīng)濟(jì)發(fā)展所需將難以為繼。環(huán)境就是民生,有效的保護(hù)生態(tài)環(huán)境和合理的利用自然資源,需要依賴政府科學(xué)的決策,企業(yè)積極的配合,也需要每一個(gè)公民都承擔(dān)起保護(hù)環(huán)境的責(zé)任和義務(wù)。政府作為公共事務(wù)的直接管理者,在現(xiàn)代社會(huì)占據(jù)主導(dǎo)地位,擁有最強(qiáng)大的資源優(yōu)勢(shì)和領(lǐng)導(dǎo)權(quán)威,對(duì)環(huán)境的監(jiān)管有著不可推卸的責(zé)任。但是政府在環(huán)境監(jiān)管的過(guò)程中,存在著農(nóng)村環(huán)境監(jiān)管不到位、公眾參與度低、基層環(huán)境監(jiān)管能力薄弱等問(wèn)題,制約著經(jīng)濟(jì)社會(huì)可持續(xù)發(fā)展的進(jìn)程,經(jīng)濟(jì)發(fā)展與環(huán)境保護(hù)難以達(dá)到一個(gè)平衡點(diǎn)。因此,如何有效的治理環(huán)境污染、改善環(huán)境質(zhì)量,成為鄂爾多斯市戰(zhàn)略發(fā)展的重點(diǎn)問(wèn)題,也成為公眾關(guān)心的焦點(diǎn)問(wèn)題;诘胤秸诃h(huán)境監(jiān)管過(guò)程中所處的地位及作用,本文以提出問(wèn)題—分析問(wèn)題—解決問(wèn)題為邏輯主線,對(duì)鄂爾多斯地區(qū)政府環(huán)境監(jiān)管的現(xiàn)狀從監(jiān)管的職能機(jī)構(gòu)、制度、體制、手段四個(gè)角度進(jìn)行分析,在肯定成績(jī)的同時(shí),認(rèn)為政府對(duì)環(huán)境監(jiān)管存在以下問(wèn)題:在監(jiān)管區(qū)域方面,政府環(huán)境規(guī)制重城市、輕農(nóng)村;在監(jiān)管制度方面,環(huán)境監(jiān)管公眾參與度低;在監(jiān)管體制方面,橫向?qū)用娓餍衅湔?縱向?qū)用姹O(jiān)管權(quán)力受限;在監(jiān)管手段方面,基層環(huán)境監(jiān)管能力薄弱。經(jīng)過(guò)分析研究,本文認(rèn)為上述問(wèn)題產(chǎn)生的原因分別是:政府環(huán)境監(jiān)管職能不完善;公眾參與制度不健全;環(huán)境監(jiān)管雙重領(lǐng)導(dǎo),機(jī)制不完善;環(huán)保投入比重小,缺乏技術(shù)支撐。通過(guò)分析問(wèn)題產(chǎn)生的原因并學(xué)習(xí)國(guó)外環(huán)境監(jiān)管先進(jìn)經(jīng)驗(yàn),本文就加強(qiáng)鄂爾多斯地區(qū)政府環(huán)境監(jiān)管提出了規(guī)范政府責(zé)任,實(shí)現(xiàn)城鄉(xiāng)一體化監(jiān)管;加強(qiáng)促進(jìn)公眾參與的相關(guān)制度建設(shè);優(yōu)化環(huán)境監(jiān)管權(quán)力配置,健全環(huán)境監(jiān)管機(jī)制;推動(dòng)和加強(qiáng)基層環(huán)境監(jiān)管能力建設(shè)等方面的對(duì)策建議。
[Abstract]:During the 13th Five-Year Plan period, environmental protection and the construction of ecological civilization both entered a new normal. Economic development showed a trend of rapid growth, but with the growth of the economy, the situation of resources and environment deteriorated sharply. And the environmental capacity and the intensity of resource consumption will be difficult to sustain the economic development. The environment is people's livelihood, the effective protection of ecological environment and rational use of natural resources, need to rely on the government scientific decision-making, enterprises actively cooperate, but also need every citizen to assume the responsibility and obligation to protect the environment. As the direct manager of public affairs, the government occupies a dominant position in modern society, has the most powerful resource advantage and leading authority, and has the unshirkable responsibility to supervise the environment. However, in the process of environmental supervision, there are some problems, such as the lack of rural environmental supervision, the low public participation, the weak capacity of grass-roots environmental supervision and so on, which restrict the process of sustainable economic and social development. It is difficult to achieve a balance point between economic development and environmental protection. Therefore, how to effectively control environmental pollution and improve environmental quality has become a key issue in the strategic development of Ordos, and has also become the focus of public concern. Based on the position and function of the local government in the process of environmental supervision, this paper takes putting forward the problem-analysis problem-solving problem as the logical main line, and analyzes the current situation of the government environmental supervision in Ordos region from the function organization, system and system of supervision. From four angles of analysis, the author thinks that the government has the following problems in environmental supervision: in the area of supervision, the government pays more attention to the city than the countryside, and the public participation in the environmental regulation is low in the aspect of the supervision system. In the aspect of the supervision system, the horizontal level has its own administration, the vertical level is limited; in the aspect of the supervision means, the basic level environmental supervision ability is weak. After analysis and research, this paper thinks that the reasons for the above problems are: the function of government environmental supervision is not perfect; the system of public participation is not perfect; the dual leadership of environmental regulation, the mechanism is not perfect; the proportion of environmental protection investment is small, lack of technical support. By analyzing the causes of the problems and learning the advanced experience of foreign environmental supervision, this paper puts forward to standardize the responsibility of the government to strengthen the environmental supervision in Ordos region and realize the integrated supervision of urban and rural areas. Strengthen the relevant system construction to promote public participation; optimize the allocation of environmental supervision power and improve the environmental regulatory mechanism; promote and strengthen the grass-roots environmental regulatory capacity building and other aspects of countermeasures and suggestions.
