【摘要】：環(huán)境影響評(píng)價(jià)制度在我國(guó)已實(shí)行近40年,環(huán)境影響評(píng)價(jià)機(jī)構(gòu)作為我國(guó)唯一有資質(zhì)接受委托為建設(shè)項(xiàng)目環(huán)境影響評(píng)價(jià)提供技術(shù)服務(wù)的機(jī)構(gòu),為環(huán)境影響評(píng)價(jià)工作的順利開(kāi)展起到了不可替代的作用。隨著紅頂機(jī)構(gòu)脫鉤改制的完成,環(huán)境影響評(píng)價(jià)中被詬病的紅頂中介問(wèn)題已基本解決。但目前環(huán)境影響評(píng)價(jià)機(jī)構(gòu)仍存在許多的問(wèn)題。本文運(yùn)用治理理論等,剖析了環(huán)境影響評(píng)價(jià)機(jī)構(gòu)治理困局出現(xiàn)的原因,并在此基礎(chǔ)上給出了完善環(huán)境影響評(píng)價(jià)機(jī)構(gòu)治理的路徑。全文共有四章:第一章,我國(guó)環(huán)境影響評(píng)價(jià)機(jī)構(gòu)發(fā)展及存在的問(wèn)題。文章介紹了我國(guó)環(huán)境影響評(píng)價(jià)機(jī)構(gòu)發(fā)展的概況,并從環(huán)境影響評(píng)價(jià)機(jī)構(gòu)的資質(zhì)管理,與政府部門的關(guān)系,文件的編制過(guò)程和機(jī)構(gòu)內(nèi)部管理等角度指出了環(huán)境影響評(píng)價(jià)機(jī)構(gòu)存在的普遍問(wèn)題。第二章,環(huán)境影響評(píng)價(jià)機(jī)構(gòu)治理的理論基礎(chǔ)。文章介紹了治理理論,利益沖突與利益平衡理論及權(quán)力的制衡與監(jiān)督,并對(duì)其在環(huán)境影響評(píng)價(jià)機(jī)構(gòu)治理中的應(yīng)用做了具體分析。第三章,環(huán)境影響評(píng)價(jià)機(jī)構(gòu)治理的困境。本章主要從以下四個(gè)方面分析了導(dǎo)致環(huán)境影響評(píng)價(jià)機(jī)構(gòu)治理困境的原因。權(quán)威型治理模式下政府監(jiān)管能力有限,中觀治理層面行業(yè)自律缺失,環(huán)境影響評(píng)價(jià)機(jī)構(gòu)采用公司制的組織形式不利于其微觀治理的實(shí)現(xiàn),法律關(guān)于環(huán)境影響評(píng)價(jià)機(jī)構(gòu)連帶責(zé)任的規(guī)定亦不完善。由于缺乏合理的制度設(shè)計(jì),作為治理的重要主體之一的公眾,參與不到位。第四章,完善環(huán)境影響評(píng)價(jià)機(jī)構(gòu)治理的路徑建議。在環(huán)境影響評(píng)價(jià)機(jī)構(gòu)的治理中,應(yīng)建立多中心的治理機(jī)制。首先,應(yīng)完善對(duì)環(huán)境影響評(píng)價(jià)機(jī)構(gòu)的行政監(jiān)管。其次,通過(guò)賦予行業(yè)協(xié)會(huì)完整的自律職能,加強(qiáng)自律組織自身建設(shè)等,真正實(shí)現(xiàn)行業(yè)自治。再次,通過(guò)組織形式的合伙制改革,完善連帶責(zé)任制度等實(shí)現(xiàn)環(huán)境影響評(píng)價(jià)機(jī)構(gòu)微觀層面的治理。最后,通過(guò)公眾參與制度的完善,實(shí)現(xiàn)公眾對(duì)其他治理主體的監(jiān)督。
[Abstract]:The environmental impact assessment system in China in the past 40 years, the environmental impact assessment agencies as China's only qualified commissioned for the construction project environmental impact assessment agencies to provide technical services, for the environmental impact assessment work has played an irreplaceable role. With the completion of the top agencies from restructuring, red intermediary problem has been criticized in the environmental impact assessment has been basically solved. But the mechanism of environmental impact assessment there are still many problems. This paper uses governance theory, analyzes the causes of Environmental Impact Assessment Organization Governance Dilemma appears, and then gives the path to improve the environmental impact assessment institutions. There are four chapters in this paper: the first chapter, China's environmental impact assessment organization development and the existing problems. The article introduces the general situation of China's environmental impact assessment organization development, and to evaluate the environmental impact from the machine The qualification management of the relationship between government departments and the angle of documentation process and mechanism of internal management and points out the common problems existing in the environmental impact assessment agencies. In the second chapter, the theoretical basis of environmental impact assessment organization governance. This paper introduces the theory of governance, supervision and balance the conflict of interests and the theory of balance of interests and power, and on the concrete analysis done in the application of environmental impact assessment of institutional governance. In the third chapter, environmental impact assessment organization governance. This chapter mainly from the following four aspects analyzes the causes of the environmental impact assessment of Governance Dilemma. The authority of governance mode of government supervision of limited capacity, lack of self-discipline middle management level. Implementation of the environmental impact assessment agencies adopted corporate form of organization is not conducive to the corporate governance, laws and regulations on environmental impact assessment mechanism of joint liability is not Perfect. Due to the lack of rational design of the system, as one of the important subjects of public governance, participation is not in place. In the fourth chapter, the ways to improve the evaluation mechanism of environmental impact management in the management of environmental impact assessment agencies, should establish a multi center governance mechanism. Firstly, should perfect the administrative supervision evaluation mechanism of impact on the environment secondly, through self-discipline functions entrusted to complete industry associations to strengthen self-discipline, self construction, realize the autonomy of industry. Thirdly, the organization form of partnership reform, improve joint responsibility system of governance evaluation mechanism of micro level environmental impact. Finally, through the improvement of the system of public participation, the realization of public supervision on the other the subject of governance.
