【摘要】：在生態(tài)文明語境下,建立和完善生態(tài)環(huán)境損害法律責任制度至關重要。為此,就需要厘清生態(tài)環(huán)境法律責任的性質(zhì)、承擔方式和救濟途徑。為此,我們選擇了一組論文就此展開專題討論�！墩摗辞謾嘭熑畏ā档�68條之部分連帶責任性質(zhì)》一文從《侵權責任法》第68條性質(zhì)之爭議談起,分析了"部分連帶責任"說的合理性以及環(huán)境侵權司法解釋與《侵權責任法》之契合之處�！渡鷳B(tài)修復法律責任之偏見與新識》一文則認為,生態(tài)修復法律責任與環(huán)境法律責任存在顯著區(qū)別,在此基礎上進一步明確了其法律性質(zhì)和承擔方式�！睹绹廴緭p害評估法制及其借鑒》一文則以比較法視角分析了美國水污染損害評估法律實踐及其借鑒意義,進而從法律救濟的角度提出了健全和完善我國水污染損害評估法制的對策建議。
[Abstract]:In the context of ecological civilization, it is very important to establish and improve the legal responsibility system of ecological environmental damage. To this end, it is necessary to clarify the nature of the legal responsibility of the ecological environment, the way of undertaking and the way of relief. To this end, we have chosen a group of papers to discuss this topic. On the sixty-eighth part of the tort liability law, the nature of joint and several liability is discussed from the dispute of the sixty-eighth nature of the tort liability law. The rationality of the theory of partial joint liability is analyzed, and the correspondence between the environmental tort judicial interpretation and the tort liability law is analyzed. According to the biases and new understanding of the legal liability of ecological restoration, there is a significant difference between the legal responsibility of ecological restoration and the environmental liability. On this basis, we further clarify the legal nature and the way of commitment. "Water pollution damage assessment system and a" American reference in the perspective of comparative law analysis of the water pollution damage evaluation of American legal practice and its significance, and then from the angle of legal remedy is put forward to improve and perfect the legal system of China's water pollution damage assessment countermeasures.
