在義務(wù)之外——試析以色列極端正統(tǒng)派猶太教徒的兵役問題

【摘要】：以色列實行全民義務(wù)兵役制,但包括猶太教經(jīng)學(xué)院學(xué)生在內(nèi)的一些團體被集體免除兵役義務(wù)。由于極端正統(tǒng)派猶太教"學(xué)者社團"的特性,免除經(jīng)學(xué)院學(xué)生的兵役義務(wù)事實上免除了所有適齡極端正統(tǒng)派猶太教徒的兵役義務(wù)。為該項免除提供法律依據(jù)的《塔勒法》(Tal Law)造成嚴(yán)重的社會不公,引起以色列世俗勢力的強烈反對,在2012年2月被以色列最高法院判決違憲。這造成以色列社會的分裂并引發(fā)2012年5月以色列執(zhí)政聯(lián)盟危機。極端正統(tǒng)派猶太教徒的兵役問題,是以色列世俗與宗教勢力之間矛盾的體現(xiàn),對以色列的社會穩(wěn)定及政局的發(fā)展有重要影響。
[Abstract]:Israel has a compulsory military service, but some groups, including students at the Judaism Academy, are collectively exempted from military service. By virtue of the characteristics of the "academic community" of ultra-Orthodox Judaism, the exemption of college students from military service in fact exonerated all ultra-Orthodox Jews of appropriate age from military service. The Tall Law, which provided the legal basis for the exemption, caused serious social injustice, aroused strong opposition from Israel's secular forces, and was ruled unconstitutional by the Israeli Supreme Court in February 2012. This has divided Israeli society and triggered the crisis of the ruling coalition in May 2012. The issue of the military service of the ultra-Orthodox Jews is the embodiment of the contradiction between the secular and religious forces in Israel and has an important impact on the social stability and the development of the political situation in Israel.
