【摘要】：戰(zhàn)國(guó)時(shí)代聶政復(fù)仇故事的三個(gè)著名敘事背后,是不同時(shí)代的敘事者對(duì)于復(fù)仇正當(dāng)性不同的禮法闡釋。從復(fù)仇的敘事倫理變遷來理解復(fù)仇的法律規(guī)制,可以提出一個(gè)以三綱五倫為核心的儒家倫理與限制復(fù)仇的王朝法律的互動(dòng)變遷的理論模型。這對(duì)當(dāng)代"死刑存廢"等法治建設(shè)的現(xiàn)實(shí)爭(zhēng)議也有所啟發(fā)。
[Abstract]:Behind the three famous narratives of Nie Zheng's revenge story during the warring States period is the different propriety interpretation of revenge legitimacy by narrators of different times. To understand the legal regulation of revenge from the perspective of narrative ethical changes of revenge, we can put forward a theoretical model of the interactive changes of Confucian ethics with the core of "three elements and five barons" and the law of dynasty with restrictions on revenge. This is also enlightening the contemporary "death penalty to save and abolish" and other legal construction of the reality of controversy.
