【摘要】：“禮不下庶人 ,刑不上大夫”見于漢傳經(jīng)典 ,但這句話本身是有問題的 ,東漢許慎已提出質(zhì)疑。依據(jù)近年出土的竹書 ,可知“禮不下庶人 ,刑不上大夫”是由先秦經(jīng)典中的文句“刑不逮于君子 ,禮不逮于小人”演變而來(lái)的 ,認(rèn)真分析相關(guān)問題 ,對(duì)于我們重新認(rèn)識(shí)中國(guó)先秦的法制性質(zhì)具有重要參考意義。
[Abstract]:"ritual is not inferior to common people, punishment is not doctor," in the classic Han Dynasty, but this sentence itself is problematic, the Eastern Han Xu Shen has questioned. According to the bamboo books unearthed in recent years, we can see that "courtesy is not below the common people, punishment is not on the doctor" is derived from the phrase "punishment does not catch the gentleman, the ceremony does not catch the villain" in the classic of the Pre-Qin Dynasty, and the relevant problems are carefully analyzed. For us to re-understand the legal nature of China's pre-Qin Dynasty has an important reference.
