【摘要】：“術(shù)”字本身是一個(gè)中性詞，一般我們可以把它理解為方法和手段，其在不同的篇章和語言環(huán)境下有著不同的解釋意義：法家的術(shù)，主要是用來解決君主與臣子的矛盾，，是為加強(qiáng)君主中央集權(quán)服務(wù)的；從術(shù)論與“法”和“勢(shì)”思想的關(guān)系上看：一方面，術(shù)論與“法”、“勢(shì)”思想相結(jié)合，并且以“法”、“勢(shì)”來解釋“術(shù)”，三者都是為君主服務(wù)的；另一方面，術(shù)論與“法”和“勢(shì)”的思想在性質(zhì)，內(nèi)容等各方面是不同的；本論文通過對(duì)法家術(shù)論的演變過程，法家術(shù)論的主要內(nèi)容以及術(shù)論的適用范圍的研究，并在此基礎(chǔ)上探討術(shù)論的社會(huì)作用和影響，法家術(shù)論和儒家術(shù)論的關(guān)系等，本論文主要分為三部分： 第一部分是本論文的理論部分,包括緒論和第一章，主要是術(shù)論的研究背景、研究意義、研究方法和內(nèi)容，同時(shí)說明國內(nèi)外的研究現(xiàn)狀；第一章主要講的是術(shù)論的演變過程，包含“術(shù)”的產(chǎn)生、發(fā)展和術(shù)論的大成。 第二部分是本論文闡述的重點(diǎn),包括第二章、第三章和第四章，在前兩章的基礎(chǔ)上進(jìn)一步探討術(shù)論的主要內(nèi)容，術(shù)論區(qū)別于其他思想的基本特征和人性論基礎(chǔ)，第四章主要關(guān)于術(shù)論的社會(huì)影響和作用。 第三部分包括第五章，在上面兩部分的基礎(chǔ)上進(jìn)行術(shù)論與“法”、勢(shì)思想的比較研究，突出“術(shù)”的中心地位。
[Abstract]:The word "art" itself is a neutral word, generally we can understand it as a method and means, it has different interpretation meaning in different text and language environment: the art of the Legalist is mainly used to solve the contradiction between the monarch and his subjects. It is to strengthen the monarch's centralization of power, from the view of the relationship between the theory of skill and the thought of "law" and "power": on the one hand, the theory of art combines with the thought of "law" and "power", and explains "art" by "law" and "power", all of which serve the monarch; On the other hand, the thought of "art theory" and "law" and "potential" are different in nature and content. On this basis, this paper discusses the social role and influence of the theory of art, the relationship between the theory of legalism and the theory of Confucianism, etc. This paper is divided into three parts:. The first part is the theoretical part of this paper, including the introduction and the first chapter, mainly is the research background, research significance, research methods and contents of the technology theory, at the same time, it explains the current situation of the research at home and abroad, the first chapter mainly talks about the evolution process of the technology theory. It contains the emergence, development and great achievement of the theory of "skill". The second part is the focus of this paper, including the second chapter, the third chapter and the 4th chapter. On the basis of the first two chapters, the author further discusses the main contents of the theory of technology, which is different from the basic characteristics of other thoughts and the basis of the theory of human nature. Chapter 4th focuses on the social impact and role of the theory of technology. The third part includes 5th chapters. On the basis of the above two parts, the author makes a comparative study of the thought of "skill" and "law", and highlights the central position of "skill".
