蔣介石、陳立夫與1948年行憲組閣的困局

【摘要】：1948年5月,國(guó)民黨內(nèi)各派系圍繞立法院副院長(zhǎng)與行政院院長(zhǎng)人選問(wèn)題展開(kāi)激烈爭(zhēng)奪。陳立夫雖然在立法院副院長(zhǎng)選舉中險(xiǎn)勝,但不滿(mǎn)蔣未予其全力支持,故而陳在行政院院長(zhǎng)提名問(wèn)題上與蔣展開(kāi)激烈較量。蔣介石支持張群蟬聯(lián)行政院院長(zhǎng),CC系則推舉何應(yīng)欽,并制造假投票,逼蔣就范。蔣無(wú)奈選擇獲各派系認(rèn)可的翁文灝出掌內(nèi)閣。由此可清晰窺見(jiàn)國(guó)大行憲在國(guó)民黨派系政治的作用下迅速異化為各派系爭(zhēng)權(quán)奪利的工具,憲法賦予立法院的質(zhì)詢(xún)權(quán)與同意權(quán)反卻成為CC系與蔣介石進(jìn)行較量的制度保障,而國(guó)民黨內(nèi)各派系因受公開(kāi)競(jìng)選的刺激,日趨組織化與公開(kāi)化,憲政體制甚至成為加劇國(guó)民黨內(nèi)部派系紛爭(zhēng)的催化劑。
[Abstract]:In May 1948, KMT factions engaged in fierce competition over the candidates of the Legislative Yuan Vice President and Executive Yuan President. Although Chen Lifu narrowly won the election for vice-president of the Legislative Yuan, he was dissatisfied with Chiang's failure to give his full support, so Chen engaged in a fierce contest with Jiang on the nomination of president of the Executive Yuan. Jiang Jieshi supported Zhang Qun's reelection of the Executive Yuan's Department of CC to elect Ho Ying-chin and create a fake vote to force Chiang to submit. Chiang had no choice but to choose Weng Wenhao, who was recognized by various factions, to run the cabinet. From this, we can see clearly that the constitution of the National Congress is rapidly dissimilated into a tool for all factions to fight for power under the influence of KMT faction politics. However, the power of inquiry and consent given by the Constitution to the Legislative Yuan has become the institutional guarantee for the CC department to compete with Jiang Jieshi. Because the KMT factions were stimulated by the open election, they became more and more organized and open, and the constitutional system even became the catalyst to aggravate the factional disputes within the KMT.
