【摘要】：沈家本在民國元年的經歷,不僅呈現了中國法律發(fā)展史上的一位關鍵人物對辛壬鼎革的觀察與感受,包括朝禮、服色、歷法等方面;而且蘊含著歷史人物個體與轉折時代交融互動的諸多信息,如辛亥革命爆發(fā)后清廷司法中樞人員變動頻繁、新舊政權交接的諸多矛盾沖突、革故與鼎新之間錯綜復雜的關系,等等。作為前清的法界領袖與政權更迭的親歷者,沈家本除了感受時局變動、紛擾之外,其實更多的是介于歷史臺前與幕后、中心與邊緣之間的一位垂暮老者“不復與政界相周旋”的靜默,對于政治,有關心而無參與,這為鼎革之際的歷史變動提供了舒緩深沉的底色。
[Abstract]:Shen Jiaben's experience in the first year of the Republic of China not only presented a key figure in the history of Chinese law to observe and feel about the Dinning Revolution of Siren, including the ceremony, color, calendar and so on. And it contains a lot of information about the interaction between the historical figures and the turning times, such as the frequent changes of the Qing court judicial center personnel after the Xinhai Revolution, the many contradictions and conflicts between the new and the old regime, the intricate relationship between the revolution and the new. And so on. As leaders of the legal circles in the former Qing Dynasty and experienced regime changes, Shen Jiaben, in addition to feeling the changes and disturbances in the current situation, is actually more between the historical stage and the behind-the-scenes. The silence of a twilight man between the center and the edge, who is concerned but not involved in politics, provides a soothing and deep foundation for the historical changes of the Great Revolution.
