【摘要】：秦王朝滅亡的原因與法家思想之對錯是兩回事,秦始皇根據(jù)法家思想主張的君主專制思想建立了地主經(jīng)濟上的君主專制制度,這一政治制度延續(xù)了兩千余年,證明法家思想及其指導下建立的政治制度是適應當時歷史政治、經(jīng)濟需要的。法家"重刑輕罪"的立法思想指導下建立了完備的法律制度,漢律完全承繼了秦律的框架、刑罰種類,與秦律沒有根本的區(qū)別,也沒有引起政權(quán)的危機;相反,漢初"懲惡秦之政""與民休息""輕徭薄賦"造就了文景時的府庫有盈余,成就了"人得自安""人人自愛而重犯法"的"文景之治"。
[Abstract]:The reasons for the demise of the Qin Dynasty and the correctness and error of the Legalist thought are two different things. Qin Shihuang established the monarchy system of the landlord economy according to the autocratic thought of the monarchy advocated by the Legalist thought, which lasted for more than two thousand years, which proved that the Legalist thought and the political system established under its guidance met the needs of the history, politics and economy at that time. Under the guidance of the legislative thought of "serious punishment and misdemeanour", the Legalists established a complete legal system. The Han law completely inherited the framework of Qin Law, and there was no fundamental difference between the types of penalty and Qin Law, nor did it cause the crisis of political power. On the contrary, in the early Han Dynasty, the "punishment of evil Qin" and the rest of the people "light corvee and thin Fu" created the surplus of the treasury at Wenjing time, and achieved the "rule of circumstances" in which "people got their own peace" and "everyone loved themselves and repeatedly violated the law".
