【摘要】："復(fù)故爵田宅"詔表明西漢繼續(xù)秦朝授田制,劉邦時(shí)代不存在授田困難問(wèn)題�！抖曷闪睢肥乾F(xiàn)實(shí)施行的法律而非"一紙空文";漢文帝"不為民田及奴婢為限"不等于在制度上廢止授田制;漢武帝"田宅逾制"之"制"是漢初舊制而非武帝新立之制。鄭玄"漢無(wú)授田之制"有其特定含義,均不足以否定西漢授田制的存在。西漢授田制系因土地私有化的發(fā)展而逐步退出歷史舞臺(tái),而非因某一位帝王的某項(xiàng)政策而廢止,更不能因?yàn)橥恋丶娌⒍穸ā抖曷闪睢肥谔镏频臍v史存在。
[Abstract]:"the retelling of the old Jutian House" shows that the Western Han Dynasty continued the system of granting farmland in the Qin Dynasty. In the era of Liu Bang, there was no difficulty in granting land. < 2 years' decree was a practical law, not "a piece of paper", the Han Emperor's "not limited for the land and slaves" did not mean that the system of granting land should be abolished in the system. The "system" of Wu Emperor in Han Dynasty was the old system in the early Han Dynasty, not the new system of Wu Emperor. Zheng Xuan's system without granting farmland in Han Dynasty has its specific meaning, which is not enough to negate the existence of granting farmland system in the Western Han Dynasty. The land grant system of the Western Han Dynasty was gradually withdrawn from the historical stage because of the development of land privatization, not because of a certain monarch's policy, nor could it be denied the existence of the land grant system because of land annexation.
