【摘要】：本文從現(xiàn)有史料入手,對(duì)宋代民間財(cái)產(chǎn)糾紛與訴訟進(jìn)行了梳理,力圖通過(guò)對(duì)動(dòng)態(tài)的、微觀的法律現(xiàn)象的分析,來(lái)考察宋代民間財(cái)產(chǎn)關(guān)系的矛盾沖突,國(guó)家、社會(huì)對(duì)這種矛盾沖突的調(diào)整和解決,以及涉足其中的宋代民眾對(duì)法制的支持程度。　 首先簡(jiǎn)單介紹研究現(xiàn)狀、選題意義、界定研究范圍。　 第一至第四章:論述宋代民間的財(cái)產(chǎn)糾紛與訴訟現(xiàn)象。宋代是中國(guó)古代社會(huì)經(jīng)濟(jì)大發(fā)展的階段,在當(dāng)時(shí)的經(jīng)濟(jì)大潮沖擊下,人們之間的互相理解和責(zé)任感變得淡漠起來(lái),大部分宋人的精神世界為利益規(guī)律所統(tǒng)治,由此,人們之間也產(chǎn)生了各式各樣的財(cái)產(chǎn)沖突。這幾部分分別考察了宋代民間廣泛存在的圍繞田宅、錢(qián)債、共財(cái)與奩產(chǎn)、遺產(chǎn)繼承而產(chǎn)生的糾紛與爭(zhēng)訟現(xiàn)象,再現(xiàn)了社會(huì)各成員的利義抉擇�！� 第五章:民間調(diào)解與官府調(diào)解。由于社會(huì)結(jié)構(gòu)、文化傳統(tǒng)、訴訟效益等多種因素的影響,宋代民間的財(cái)產(chǎn)糾紛中相當(dāng)一部分由民間自行調(diào)解解決,但也有一部分財(cái)產(chǎn)糾紛以訴訟途徑來(lái)解決,由官府調(diào)處息訟。　 第六章:宋代民間財(cái)產(chǎn)糾紛與訴訟案件的執(zhí)行。特定的社會(huì)結(jié)構(gòu)、法律背景帶給宋民事執(zhí)行濃厚的倫理法色彩,使其呈現(xiàn)出非規(guī)范化特征。　 第七章:宋代民間財(cái)產(chǎn)糾紛與訴訟中的法律觀念。通過(guò)對(duì)宋代民間財(cái)產(chǎn)糾紛與訴訟由發(fā)生到解決的全過(guò)程的考察,我們發(fā)現(xiàn),在糾紛解決方式的選擇上,宋代民眾的法律價(jià)值觀念起著至關(guān)重要的作用,他們對(duì)法制的支持并非毫無(wú)保留�！� 最后,概括本文的主要結(jié)論�！�
[Abstract]:Starting with the existing historical data, this paper combs the disputes and litigation of folk property in the Song Dynasty, and tries to investigate the contradiction and conflict of the folk property relations in the Song Dynasty through the analysis of the dynamic and microscopic legal phenomena. The society adjusts and resolves these contradictions and conflicts, as well as the people's support to the legal system in Song Dynasty. First of all, a brief introduction of the status of the study, the significance of the topic, define the scope of the study. The first to 4th chapters: discusses the property dispute and the lawsuit phenomenon in the Song Dynasty. The Song Dynasty is the stage of the great development of the society and economy in ancient China. Under the impact of the economic tide at that time, the mutual understanding and the sense of responsibility between the people become indifferent. Most of the spiritual world of the Song Dynasty was ruled by the law of interests. As a result, there were also various conflicts of property among the people. These parts examined the widespread existence of the folk around the field house, the money and the debt, the common wealth and the dowry property in the Song Dynasty. The disputes and disputes arising from inheritance reappear the choice of benefit and righteousness of the members of the society. Chapter 5th: folk mediation and government mediation. Due to the influence of social structure, cultural tradition, litigation efficiency and other factors, a considerable part of the civil property disputes in the Song Dynasty were settled by private mediation. But there are also some property disputes to be resolved by way of litigation, by the government mediation interest litigation. Chapter 6th: the civil property disputes and the execution of litigation cases in Song Dynasty. The specific social structure and legal background bring the strong ethical law color to Song civil execution and make it show the characteristics of non-standardization. Chapter 7th: the concept of law in civil property disputes and litigation in Song Dynasty. Through the investigation of the whole process from occurrence to settlement of civil property disputes and litigation in Song Dynasty, we find that, in the choice of dispute resolution, The legal values of the Song Dynasty played a vital role, and their support for the legal system was not without reservation. Finally, the main conclusions of this paper are summarized.
