【摘要】：我國國際爭端解決機制尚未在"一帶一路"沿線國間自然形成中心地位,構建調(diào)解、仲裁、司法三位一體的"一帶一路"爭端解決中心應從當下和未來兩個層面進行價值考量:調(diào)解、仲裁和司法三位一體模式的爭端解決中心是國家海外貿(mào)易及投資權益維護舉措的應急與補缺;是推動相關爭端爭端交由"一帶一路"沿線國家共同參與的爭端解決機構進行裁判的試驗場。以此為近期目標,"一帶一路"爭端解決中心建設需要理性地接納境外仲裁機構進入中國并與中國爭端解決機構合作;需要改變司法主權過度擴張的觀念以促進司法協(xié)助和合作;需要推進調(diào)解機制的國際協(xié)調(diào)及"軟法規(guī)制"。"一帶一路"多元爭端解決中心的近期功能受制于沿線國的信任度以及當事方的意思自治,而其承載的誠信文化溝通、"一帶一路"區(qū)域仲裁機構形成以及國際化人才培養(yǎng)的三大遠期功能將是建設該中心的核心價值所在。
[Abstract]:China's international dispute settlement mechanism has not yet formed a central position naturally among the countries along "Belt and Road" to build mediation and arbitration. The judicial trinity of "Belt and Road" dispute settlement center should be from the present and the future two levels of value consideration: mediation, Arbitration and judicial trinity model of dispute settlement center is a national overseas trade and investment rights and interests protection initiatives emergency and fill the gap; It is a test ground to push the dispute to be adjudicated by the dispute settlement body of the countries along Belt and Road. As a short-term goal, the construction of "Belt and Road" dispute settlement center requires rational admission of overseas arbitration institutions into China and cooperation with Chinese dispute settlement bodies. There is a need to change the notion of excessive expansion of judicial sovereignty in order to promote mutual legal assistance and cooperation, and to promote international coordination and "soft regulation" of mediation mechanisms. " Belt and Road's recent functions are limited by the trust of the countries along the route and the autonomy of the parties concerned. The three long-term functions of the formation of Belt and Road regional arbitration institution and the training of international talents will be the core value of constructing the center.
