TiSA背景下中國(guó)對(duì)外服務(wù)貿(mào)易的法律問(wèn)題研究

【摘要】:隨著服務(wù)業(yè)的發(fā)展和服務(wù)貿(mào)易的興起,部分發(fā)達(dá)國(guó)家為繞開(kāi)受阻的"多哈回合"談判,促進(jìn)全球服務(wù)貿(mào)易自由化,組成服務(wù)業(yè)摯友集團(tuán),于2013年發(fā)起服務(wù)貿(mào)易協(xié)定(TiSA)談判,TiSA談判以GATS文本為基礎(chǔ),以達(dá)成多邊貿(mào)易協(xié)定為最終目標(biāo)。TiSA參與方目前有23個(gè),中國(guó)已于2013年申請(qǐng)加入,但是尚未被接受。TiSA的啟動(dòng)對(duì)全球服務(wù)貿(mào)易進(jìn)一步開(kāi)放有積極的作用。在國(guó)際環(huán)境方面,TiSA實(shí)現(xiàn)多邊化將有助于全球服務(wù)貿(mào)易的進(jìn)一步自由化,并為我國(guó)推進(jìn)"一帶一路"等區(qū)域貿(mào)易合作提供了規(guī)則標(biāo)準(zhǔn)。在國(guó)內(nèi)環(huán)境方面,TiSA對(duì)我國(guó)的服務(wù)貿(mào)易法律發(fā)展具有導(dǎo)向意義,為我國(guó)審視對(duì)外服務(wù)貿(mào)易的法律問(wèn)題提供契機(jī)。因而,我國(guó)應(yīng)及時(shí)結(jié)合TiSA的相關(guān)議題,對(duì)我國(guó)對(duì)外服務(wù)貿(mào)易法律亟需改進(jìn)的問(wèn)題進(jìn)行分析,發(fā)現(xiàn)我國(guó)法律與國(guó)際貿(mào)易規(guī)則之間的差距。但同時(shí),TiSA的實(shí)施可能對(duì)部分國(guó)家產(chǎn)生不利影響。由于TiSA提出的相關(guān)貿(mào)易規(guī)則自由化程度較高,完全采用可能會(huì)對(duì)發(fā)展中國(guó)家的服務(wù)行業(yè)產(chǎn)生沖擊。在這種前提下,我國(guó)應(yīng)當(dāng)在國(guó)際服務(wù)貿(mào)易中審視自己的發(fā)展水平和地位,以發(fā)展中國(guó)家的定位,為今后應(yīng)對(duì)TiSA以及參與國(guó)際貿(mào)易談判制定符合中國(guó)國(guó)情的基本策略。在全球貿(mào)易合作進(jìn)一步自由化的趨勢(shì)下,更為緊迫的是,我國(guó)應(yīng)當(dāng)對(duì)國(guó)內(nèi)對(duì)外服務(wù)貿(mào)易法律進(jìn)行完善。法律制度是保障一個(gè)行業(yè)健康發(fā)展的指引者和守護(hù)者。不論我國(guó)最終能否加入TiSA,其所代表的國(guó)際服務(wù)貿(mào)易開(kāi)放趨勢(shì)都將對(duì)我國(guó)服務(wù)業(yè)發(fā)展和對(duì)外服務(wù)貿(mào)易法律水平提出新的要求。因而,在學(xué)習(xí)TiSA高水平開(kāi)放的貿(mào)易規(guī)則基礎(chǔ)上,應(yīng)結(jié)合我國(guó)的發(fā)展目標(biāo)和基本國(guó)情,及時(shí)制定符合我國(guó)利益的對(duì)外服務(wù)貿(mào)易法律制度。雖然目前我國(guó)已加速推進(jìn)對(duì)外服務(wù)貿(mào)易法律的修訂,如《外商投資法》(草案征求意見(jiàn)稿)、2016年版《外商投資產(chǎn)業(yè)指導(dǎo)目錄》(修訂稿),并積極在自由貿(mào)易試驗(yàn)區(qū)中積累經(jīng)驗(yàn),但是與發(fā)達(dá)國(guó)家相比,仍有一定差距。因而本文結(jié)合TiSA對(duì)我國(guó)的立法導(dǎo)向意義,以使國(guó)內(nèi)服務(wù)貿(mào)易法律與國(guó)際接軌為目標(biāo),主要從市場(chǎng)準(zhǔn)入、國(guó)內(nèi)監(jiān)管、國(guó)有壁壘及個(gè)人數(shù)據(jù)保護(hù)等方面,對(duì)我國(guó)修改和完善對(duì)外服務(wù)貿(mào)易法律提出建議。
[Abstract]:With the development of services and the rise of trade in services, some developed countries, in order to circumvent the "Doha Round" negotiations that have been blocked, promote the liberalization of global trade in services and form a group of best friends in services. Launching the (TiSA) negotiations on trade in services in 2013. The negotiations are based on the GATS text, with the ultimate goal of reaching a multilateral trade agreement. There are now 23 participants. China applied for membership in 2013. But it has not been accepted that the initiation of. TiSA has a positive effect on the further opening of global trade in services. In the aspect of international environment, the multilateral implementation of TiSA will contribute to the further liberalization of global trade in services and provide a standard for China to promote regional trade cooperation such as "Belt and Road". In terms of domestic environment, TiSA is of guiding significance to the legal development of China's service trade, and provides an opportunity for our country to examine the legal problems of foreign trade in services. Therefore, our country should combine the relevant issues of TiSA in time, analyze the problems that need to be improved in our country's foreign trade in services law, and find out the gap between our country's law and the rules of international trade. But at the same time, the implementation of TiSA may have a negative impact on some countries. Due to the high degree of liberalization of the relevant trade rules proposed by TiSA, the full adoption of the rules may have an impact on the services industry in developing countries. Under this premise, our country should examine its development level and position in international trade in services, in order to develop the position of developing country, and make the basic strategy in accordance with China's national conditions in order to deal with TiSA and participate in international trade negotiation in the future. In the trend of further liberalization of global trade cooperation, it is more urgent that our country should perfect the domestic and foreign service trade laws. The legal system is a guide and guardian for the healthy development of an industry. Whether China can finally join the TiSA, or not, the opening trend of international service trade represented by it will put forward new requirements for the development of our service industry and the legal level of foreign service trade. Therefore, on the basis of studying the high level and open trade rules of TiSA, it is necessary to formulate the legal system of foreign service trade in time in accordance with our country's development goal and basic national conditions. Although China has accelerated the revision of foreign trade in services laws, such as the "Law on Foreign Investment" (draft for comments), the 2016 edition of the "Directory of Industry guidance for Foreign Investment" (revised draft), and actively accumulated experience in the free trade experimental area, But compared with the developed countries, there is still a certain gap. Therefore, combining with the significance of TiSA's legislation guidance to our country, this paper aims to make domestic service trade law in line with international standards, mainly from the aspects of market access, domestic supervision, state-owned barriers and personal data protection, etc. To our country to revise and perfect the law of foreign trade in services.
