【摘要】：在綠色"一帶一路"建設(shè)中強化環(huán)境法規(guī)制具有必需性和迫切性。"一帶一路"沿線部分國家普遍存在生態(tài)環(huán)境脆弱的客觀情況,而我國海外投資實行長期開發(fā)新模式,出于提升我國環(huán)境保護(hù)形象和防范環(huán)境風(fēng)險引發(fā)經(jīng)濟風(fēng)險等目的,都亟待強化環(huán)境法規(guī)制。綠色"一帶一路"要求我國"走出去"的企業(yè)接受東道國環(huán)境法的規(guī)制,同時自覺對接我國有關(guān)主管部門的依法監(jiān)管。當(dāng)前我國涉外環(huán)境立法嚴(yán)重不足,對"走出去"的企業(yè)缺乏環(huán)境監(jiān)管;司法機關(guān)受管轄權(quán)限制難以發(fā)揮職能作用;企業(yè)因守法意識淡漠而易引發(fā)諸多環(huán)境糾紛。我國應(yīng)當(dāng)堅守人類命運共同體理念和國際環(huán)境法的基本原則;對"走出去"的企業(yè)從環(huán)境立法、環(huán)境行政監(jiān)管、促進(jìn)企業(yè)"合規(guī)"經(jīng)營等方面進(jìn)行指導(dǎo)監(jiān)督;將司法機關(guān)發(fā)揮審判職能作用與建立健全國際多元化環(huán)境糾紛解決機制相結(jié)合,高效解決建設(shè)"一帶一路"進(jìn)程中的各類環(huán)境糾紛,依法保障建設(shè)"一帶一路"目標(biāo)的全面實現(xiàn)。
[Abstract]:It is necessary and urgent to strengthen the regulation of environmental law in the construction of green Belt and Road. " The objective situation of fragile ecological environment exists in some countries along the route of Belt and Road, while China's overseas investment implements a new pattern of long-term development for the purpose of enhancing our image of environmental protection and preventing economic risks arising from environmental risks. It is urgent to strengthen the regulation of environmental law. The green "Belt and Road" requires the enterprises that go out of our country to accept the regulation of the environmental law of the host country, and at the same time consciously connect with the legal supervision of the relevant authorities in our country. At present, the environmental legislation concerning foreign affairs in our country is seriously inadequate, and the enterprises that "go out" lack of environmental supervision; the judicial organs are difficult to play their functions under the restriction of jurisdiction; the enterprises are prone to lead to many environmental disputes because of their lack of awareness of abiding by the law. Our country should adhere to the concept of human destiny community and the basic principles of international environmental law, guide and supervise the "going out" enterprises from the aspects of environmental legislation, environmental administrative supervision, promoting enterprises'"compliance" management, etc. Combining the judicial function with the establishment and improvement of international diversified environmental dispute resolution mechanism, and effectively resolving all kinds of environmental disputes in the process of building "Belt and Road", In accordance with the law, the goal of building "Belt and Road" will be fully realized.
