【摘要】：美國南北經(jīng)濟基礎(chǔ)的差異決定了內(nèi)戰(zhàn)不可避免是學界主流的觀點。長久以來,從美國憲制運作的角度來分析內(nèi)戰(zhàn)的發(fā)生被人忽視,事實上,制度性原因的探尋亦具相當意義。19世紀上半期,美國政治體制上出現(xiàn)了諸如權(quán)力配置方面的挑戰(zhàn),同時奴隸制議題處于美國憲政轉(zhuǎn)型的中心,而立法、司法和行政各個分支在19世紀上半期的表現(xiàn)都應對內(nèi)戰(zhàn)的爆發(fā)有一定檢討之處。
[Abstract]:The differences in the economic base between the north and the south of the United States determine that civil war is inevitably the mainstream of the academic community. For a long time, it has been ignored to analyze the civil war from the point of view of the constitutional operation of the United States. In the first half of the 19th century, challenges such as power allocation emerged in the American political system, and the issue of slavery was at the center of the constitutional transformation in the United States. The judicial and administrative branches in the first half of 19th century should review the outbreak of civil war.
