【摘要】："保護的責任"是在一系列的人道主義干涉引起多種爭議下提出的,其中的一些條款被成功實施,但在肯尼亞、達爾富爾和蘇丹等有關問題上,卻引起了明顯分歧,特別是在利比亞和敘利亞出現(xiàn)危機后,大國之間的僵持引發(fā)了關于對"保護的責任"的不同理解。對于"保護的責任",中國的立場是既不全盤接受也不一概否定;而美國盡管支持"保護的責任",但卻繼續(xù)持有自己的立場。如果"保護的責任"要成為一種行之有效的全球概念、規(guī)范或原則,就需要對其合法性、范疇、含義展開深入探討,探索如何達成共識。
[Abstract]:The "responsibility to protect" has been proposed in a series of controversial humanitarian interventions, some of which have been successfully implemented, but have led to clear differences on issues related to Kenya, Darfur and the Sudan. In the wake of the crisis in Libya and Syria in particular, the standoff between the big powers has led to a different understanding of the responsibility to protect. China's position on the "responsibility to protect" is neither accepted nor denied completely, while the United States, despite supporting the responsibility to protect, continues to hold its own position. If "responsibility to protect" is to become an effective global concept, norm or principle, it is necessary to probe into its legitimacy, scope and meaning, and explore how to reach a consensus.
