【摘要】：美國(guó)對(duì)中國(guó)反補(bǔ)貼政策的轉(zhuǎn)變經(jīng)過(guò)了三個(gè)階段,從反補(bǔ)貼法不適用于非市場(chǎng)經(jīng)濟(jì)國(guó)家階段到反補(bǔ)貼法適用于非市場(chǎng)經(jīng)濟(jì)國(guó)家特定行業(yè)階段,再到反補(bǔ)貼法適用于非市場(chǎng)經(jīng)濟(jì)國(guó)家階段。到目前為止,美國(guó)對(duì)中國(guó)發(fā)起的反補(bǔ)貼調(diào)查案件占到美國(guó)對(duì)世界各國(guó)總的反補(bǔ)貼調(diào)查案件的一半以上,已成為對(duì)華反補(bǔ)貼的主要發(fā)起者,且美國(guó)對(duì)中國(guó)發(fā)起的反補(bǔ)貼調(diào)查涉及多個(gè)產(chǎn)業(yè)、多種產(chǎn)品。美國(guó)在近年來(lái)頻繁對(duì)華發(fā)起反補(bǔ)貼調(diào)查的原因包括經(jīng)濟(jì)和政治兩個(gè)方面,對(duì)中國(guó)產(chǎn)生的影響廣泛而深遠(yuǎn)。 對(duì)此,我們要積極尋求應(yīng)對(duì)、解決辦法,本文提出了短期應(yīng)對(duì)策略和長(zhǎng)期解決措施。短期內(nèi),企業(yè)要認(rèn)真應(yīng)對(duì)反補(bǔ)貼訴訟,積極配合應(yīng)訴；要在規(guī)則和程序上維護(hù)自身利益。長(zhǎng)期來(lái)看,企業(yè)、政府、行業(yè)協(xié)會(huì)三方都要做出努力,企業(yè)方面,要改變認(rèn)識(shí)誤區(qū),加強(qiáng)自律；加強(qiáng)反補(bǔ)貼知識(shí)學(xué)習(xí)的力度；提高核心競(jìng)爭(zhēng)力,改變低價(jià)策略；規(guī)范企業(yè)財(cái)務(wù)制度。政府方面,要調(diào)整補(bǔ)貼政策；建立健全事前審查、預(yù)警機(jī)制；加強(qiáng)補(bǔ)貼以及反補(bǔ)貼方面專(zhuān)業(yè)人才的培養(yǎng)。行業(yè)協(xié)會(huì)方面,要積極發(fā)揮在政府和企業(yè)間的橋梁作用；重新劃分職能,提高運(yùn)作效率。
[Abstract]:The change of countervailing policy of the United States to China has gone through three stages, from the stage that countervailing law is not applicable to non-market economy countries to the stage of applying countervailing law to specific industries in non-market economy countries. Then the anti-subsidy law applies to non-market economy countries. So far, the United States has initiated more than half of the total countervailing investigation cases against China, and has become the main sponsor of countervailing to China. And the anti-subsidy investigation initiated by the United States on China involves many industries and many products. In recent years, the United States has launched frequent countervailing investigations into China because of both economic and political aspects, which have a wide and far-reaching impact on China. In response, we should actively seek solutions, this paper puts forward short-term coping strategies and long-term solutions. In the short term, enterprises should seriously deal with countervailing actions, actively cooperate with them, and safeguard their own interests in rules and procedures. In the long run, enterprises, governments and trade associations should make efforts, and enterprises should change their misunderstandings, strengthen self-discipline, strengthen the study of countervailing knowledge, improve their core competitiveness and change their low price strategies. Standardize the financial system of enterprises. On the other hand, the government should adjust the subsidy policy, establish and perfect the pre-examination and early warning mechanism, and strengthen the training of professionals in the fields of subsidy and countervailing. In the aspect of trade association, we should actively play the role of bridge between government and enterprise, redivide the function and improve the efficiency of operation.
