【摘要】：文章追溯了"宗主權(quán)"一詞中文翻譯的出現(xiàn)過(guò)程,指出該詞是伴隨著日本國(guó)際法著述的引入,出現(xiàn)于清末,進(jìn)而認(rèn)為中國(guó)傳統(tǒng)藩屬體系與近代西方國(guó)際法宗主國(guó)—屬國(guó)關(guān)系體制不同,后者代表了當(dāng)時(shí)國(guó)際社會(huì)強(qiáng)勢(shì)規(guī)則,清朝傳統(tǒng)藩屬體系在進(jìn)入國(guó)際社會(huì)時(shí),不得不受其挑戰(zhàn)而進(jìn)行調(diào)適。在這一過(guò)程中,由于清朝對(duì)"宗主權(quán)"認(rèn)識(shí)遲鈍、國(guó)力衰弱、列強(qiáng)侵占等因素,無(wú)法最終依據(jù)當(dāng)時(shí)西方國(guó)際法規(guī)范對(duì)與越南、朝鮮等國(guó)的傳統(tǒng)藩屬關(guān)系進(jìn)行重新確立,而傳統(tǒng)藩屬體系逐漸被解體。當(dāng)"宗主權(quán)"、"宗主國(guó)"等詞語(yǔ)進(jìn)入中文成為固定的術(shù)語(yǔ)時(shí),后世學(xué)人開(kāi)始用這些詞語(yǔ)重新書(shū)寫(xiě)歷史,由此產(chǎn)生了"宗藩關(guān)系"等詞語(yǔ)。
[Abstract]:This paper traces the emergence of the Chinese translation of the term "Zong Sovereign", and points out that it appeared in the late Qing Dynasty with the introduction of Japanese international law works. It is further considered that Chinese traditional vassal system is different from modern western international law suzerain-state relationship system, which represents the strong rules of the international community at that time. When the Qing Dynasty traditional vassal system entered the international society, It has to be challenged to adapt. In this process, due to the factors such as the Qing Dynasty's slow understanding of "patriarchal sovereignty", weak national strength and encroachment by the powers, it was impossible to reestablish the traditional subordinate relations with Vietnam, Korea and other countries according to the western norms of international law at that time. The traditional vassal system was gradually disintegrated. When the words such as "patriarchal sovereignty" and "sovereign state" came into Chinese as fixed terms, later scholars began to use these words to rewrite history, resulting in words such as "suzerain-vassal relationship" and so on.
