【摘要】：議會外交的興起打破了由行政機關壟斷外交權(quán)力的結(jié)構(gòu),創(chuàng)造了一種對外交往的新范式。中國全國人民代表大會及其常委會進行的國際交往也屬于議會外交的范疇,但與西方"三權(quán)分立"體制下的制衡式的議會外交有顯著差異。對于中國議會外交的研究,應將其放置在外交分權(quán)體系之中,側(cè)重對于總體外交下全國人大的外交地位的研究,并總結(jié)中國議會外交的策略與方式。具體而言,中國的外交分權(quán)體系表現(xiàn)為成文憲法與不成文憲法相結(jié)合的"外交雙重權(quán)力格局"。議會外交既是最高國家權(quán)力的直接運行,也是執(zhí)政黨領導下的總體外交的重要環(huán)節(jié)。在全國人大內(nèi)部的職責分工上,"一院雙層"的憲制構(gòu)造使得議會外交的職能集中于常委會層面,并且建立了制度化的內(nèi)外分工協(xié)作機制。在開展議會外交過程中,全國人大逐步明確了議會外交的目標,采取了靈活多樣的策略方式,以服務于總體外交、促進經(jīng)濟發(fā)展并提升人大自身工作�，F(xiàn)有外交分權(quán)體系確定了議會外交的制度空間,而國家安全委員會的設立則為規(guī)范外交分權(quán)體系、廓清議會外交的權(quán)力邊界提供了制度契機。
[Abstract]:The rise of parliamentary diplomacy broke the structure of monopoly of diplomatic power by administrative organs and created a new paradigm of foreign communication. The international exchanges between the National people's Congress and its standing Committee also belong to the scope of parliamentary diplomacy, but there are significant differences with the parliamentary diplomacy of checks and balances under the system of "separation of powers" in the West. The study of Chinese parliamentary diplomacy should be placed in the system of diplomatic decentralization, focusing on the study of the diplomatic status of the NPC under the overall diplomacy, and summing up the strategies and methods of China's parliamentary diplomacy. Specifically, China's diplomatic decentralization system is characterized by the combination of the written constitution and the unwritten constitution. Parliamentary diplomacy is not only the direct operation of the supreme state power, but also the important link of the overall diplomacy under the leadership of the ruling party. In terms of the division of duties and responsibilities within the NPC, the constitutional structure of "one House and two tiers" makes the functions of parliamentary diplomacy concentrate on the standing committee and establish an institutionalized mechanism of internal and external division of labor and coordination. In the process of carrying out parliamentary diplomacy, the NPC has gradually defined the objectives of parliamentary diplomacy and adopted flexible and diverse tactics to serve the overall diplomacy, promote economic development and promote the work of the NPC itself. The present system of diplomatic decentralization determines the institutional space of parliamentary diplomacy, and the establishment of the National Security Committee provides an institutional opportunity for standardizing the system of diplomatic decentralization and clarifying the power boundary of parliamentary diplomacy.
