【摘要】：新世紀(jì)以來(lái),中國(guó)逐步構(gòu)建了包括地方政府在內(nèi)的"五位一體"的領(lǐng)事保護(hù)聯(lián)動(dòng)機(jī)制。地方政府在相關(guān)機(jī)制建設(shè)方面取得了重要進(jìn)展,它們協(xié)助或牽頭處理領(lǐng)事保護(hù)緊急事件,多渠道開(kāi)展領(lǐng)事保護(hù)宣傳以及海外安全教育和培訓(xùn),發(fā)揮了相當(dāng)重要乃至不可替代的作用。地方政府參與領(lǐng)事保護(hù),契合全球化背景下外交參與主體多元化的發(fā)展趨勢(shì),同時(shí)體現(xiàn)出鮮明的中國(guó)特色。中國(guó)外交部和駐外使領(lǐng)館面臨巨大的領(lǐng)事保護(hù)工作壓力,需要地方政府分擔(dān)保護(hù)責(zé)任;中國(guó)央地關(guān)系政治架構(gòu)為中央向地方分擔(dān)保護(hù)責(zé)任奠定了制度基礎(chǔ);海外中國(guó)公民因地緣聯(lián)系而聚集分布的特點(diǎn)使得地方政府在處理一些領(lǐng)事保護(hù)案件時(shí)不可或缺;地方政府本身具有某些中央政府所不具備的優(yōu)勢(shì);領(lǐng)事保護(hù)為基層外事工作提供了新的發(fā)展空間。地方政府的參與在一定程度上彌補(bǔ)了中央政府在人員和資金投入方面的不足,但也存在一些問(wèn)題,不利于領(lǐng)事保護(hù)機(jī)制的長(zhǎng)遠(yuǎn)發(fā)展,如保護(hù)責(zé)任劃分不夠合理,缺乏指導(dǎo)和統(tǒng)一的實(shí)施標(biāo)準(zhǔn),地方政府的保護(hù)責(zé)任與管理權(quán)限不平衡等等。著眼于中國(guó)領(lǐng)事保護(hù)機(jī)制的長(zhǎng)遠(yuǎn)發(fā)展,地方政府參與領(lǐng)事保護(hù)工作尚需進(jìn)一步加強(qiáng)和完善。
[Abstract]:Since the new century, China has gradually set up a "five-in-one" consular protection linkage mechanism, including local governments. Local governments have made important progress in the construction of relevant mechanisms, and they have assisted or taken the lead in handling consular protection emergencies. Multi-channel consular protection propaganda and overseas security education and training have played an important or even irreplaceable role. The participation of local governments in consular protection is in line with the trend of diversification of diplomatic participants in the context of globalization. At the same time, the Chinese Ministry of Foreign Affairs and embassies and consulates abroad are faced with enormous pressure of consular protection, which requires local governments to share the responsibility of protection; The political structure of the relationship between central and local authorities in China lays a foundation for the central authorities to share the responsibility of protection to the local authorities, and the characteristics of the gathering and distribution of overseas Chinese citizens due to geographical ties make it indispensable for local governments to deal with some cases of consular protection. The local governments themselves have some advantages that the central government does not have; consular protection provides a new space for the development of grass-roots foreign affairs. To some extent, the participation of local governments has made up for the shortcomings of the central government in terms of personnel and capital investment. However, there are also some problems which are not conducive to the long-term development of the consular protection mechanism, such as the unreasonable division of the responsibility to protect, the lack of guidance and uniform standards of implementation. Based on the long-term development of Chinese consular protection mechanism, the participation of local governments in consular protection still needs to be further strengthened and improved.
