【摘要】：人類全部社會(huì)活動(dòng)發(fā)軔于以婚姻為基礎(chǔ)的家庭生活。在婚姻這一社會(huì)活動(dòng)中，維持和調(diào)整婚姻關(guān)系的婚姻倫理內(nèi)涵豐富，歷史悠久。作為人類社會(huì)文化的一部分，人類的婚姻倫理具有共同性，但同時(shí)世界上各民族社會(huì)經(jīng)濟(jì)、政治、文化甚至地理?xiàng)l件的不同，也使婚姻倫理形成了各自的特點(diǎn)。中美文化分別是東、西方文化的典型代表，其婚姻倫理既具有共性又具有個(gè)性。 中國傳統(tǒng)婚姻倫理深受農(nóng)耕文明的影響，其基本內(nèi)容為維護(hù)父權(quán)和夫權(quán)的封建婚姻倫理。美國的傳統(tǒng)婚姻倫理受殖民社會(huì)的影響既具有封建婚姻倫理特點(diǎn)又具有資本主義婚姻倫理特點(diǎn)。同傳統(tǒng)婚姻倫理相似，中、美兩國現(xiàn)代婚姻倫理具有共性，又具有個(gè)性。新中國成立后，中國在受到社會(huì)主義經(jīng)濟(jì)、文化、法律等因素影響的同時(shí)也受到了封建經(jīng)濟(jì)因素、封建文化殘余的影響。因此，中國的婚姻倫理具有社會(huì)主義初級(jí)階段的特征。美國現(xiàn)代的婚姻倫理形成于20世紀(jì)初，，婚姻倫理具有發(fā)達(dá)資本主義階段的典型特征。 改革開放以來，中國婚姻倫理進(jìn)入新時(shí)期。受市場(chǎng)經(jīng)濟(jì)等的影響，中國家庭婚姻倫理與美國所面臨的問題大致相同。中國《婚姻法》及其司法解釋對(duì)“夫妻財(cái)產(chǎn)”的規(guī)定中所體現(xiàn)的契約精神是美國婚姻價(jià)值觀的重要內(nèi)容，這種新的夫妻財(cái)產(chǎn)制度在適應(yīng)新時(shí)期婚姻新特點(diǎn)的同時(shí)對(duì)中國的傳統(tǒng)婚姻倫理造成了沖擊。
[Abstract]:The whole social activity of mankind begins with the family life based on marriage. In the social activities of marriage, the marriage ethics connotation of maintaining and adjusting marriage relationship is rich and has a long history. As a part of human social culture, human marriage ethics has the common character, but at the same time, the different social economy, politics, culture and even geographical conditions of different nationalities in the world also make marriage ethics have their own characteristics. Chinese and American cultures are typical representatives of eastern and western cultures, and their marriage ethics have both commonness and individuality. Chinese traditional marriage ethics is deeply influenced by farming civilization, and its basic content is to maintain patriarchal and patriarchal feudal marriage ethics. Under the influence of colonial society, American traditional marriage ethics has the characteristics of feudal marriage ethics and capitalist marriage ethics. Similar to the traditional marriage ethics, China and the United States have common and unique modern marriage ethics. After the founding of New China, China was influenced by the socialist economy, culture, law and other factors, but also by the feudal economic factors, the remnants of feudal culture. Therefore, the marriage ethics in China has the characteristics of the primary stage of socialism. The modern American marriage ethics was formed in the early 20 th century, and it has the typical characteristics of the developed capitalist stage. Since the reform and opening up, Chinese marriage ethics has entered a new period. Influenced by market economy, family marriage ethics in China is similar to the problems faced by the United States. The spirit of contract embodied in the provisions of China's Marriage Law and its judicial interpretation on "marital property" is an important part of the values of marriage in the United States. This new marital property system not only adapts to the new characteristics of marriage in the new era, but also impacts the traditional marriage ethics in China.
