【摘要】：社區(qū)矯正是一種與監(jiān)禁矯正相對(duì)的、更具人性化和社會(huì)化的刑罰執(zhí)行方式,自19世紀(jì)末在西方國(guó)家實(shí)行以來(lái),因其在人權(quán)發(fā)展、效益原則等方面的獨(dú)特優(yōu)勢(shì)和兼具懲罰性與恢復(fù)性雙重價(jià)值,已成為世界許多國(guó)家刑罰體制改革和刑罰執(zhí)行的發(fā)展趨勢(shì)。我國(guó)自2003年開(kāi)展社區(qū)矯正試點(diǎn),到2009年,全國(guó)正式開(kāi)展社區(qū)矯正工作,經(jīng)過(guò)6年時(shí)間的探索總結(jié),形成了較為完備的社區(qū)矯正制度,2012年《社區(qū)矯正實(shí)施辦法》的印發(fā),標(biāo)志著我國(guó)社區(qū)矯正制度正式進(jìn)入制度化規(guī)范化軌道�！渡鐓^(qū)矯正實(shí)施辦法》中明確規(guī)定:“社會(huì)工作者和志愿者在社區(qū)矯正機(jī)構(gòu)的組織指導(dǎo)下參與社區(qū)矯正工作�！钡捎谑芩枷胗^念、機(jī)構(gòu)編制、經(jīng)濟(jì)建設(shè)各方面因素的影響,我國(guó)社會(huì)工作者很難介入到社區(qū)矯正中發(fā)揮其專(zhuān)業(yè)特長(zhǎng),特別是地處西北欠發(fā)達(dá)地區(qū)的甘肅尤為突出。社區(qū)矯正中,社會(huì)工作者介入是運(yùn)用專(zhuān)業(yè)理念和專(zhuān)業(yè)方法高效率地矯正其犯罪心理和行為惡習(xí)的最佳選擇,也是充分發(fā)揮社會(huì)工作者鏈接各種社會(huì)資源、整合社會(huì)各方面力量的比較優(yōu)勢(shì),幫助社區(qū)矯正人員順利回歸社會(huì)、反哺社會(huì)的必然要求。西方發(fā)達(dá)國(guó)家社區(qū)矯正的成功經(jīng)驗(yàn)和我國(guó)上海、港澳臺(tái)地區(qū)社區(qū)矯正的創(chuàng)新實(shí)踐,充分證明了社區(qū)矯正的社會(huì)工作介入是十分必要的。本研究經(jīng)過(guò)對(duì)甘肅省D市的實(shí)地調(diào)研,詳細(xì)梳理甘肅省社區(qū)矯正的發(fā)展?fàn)顩r,精準(zhǔn)探究社區(qū)矯正的社會(huì)工作介入廣度、深度和困難度,重點(diǎn)研究社區(qū)矯正的社會(huì)工作介入問(wèn)題分析與路徑設(shè)計(jì)。本文主要由四部分組成:第一部分,即第一章,介紹了研究背景與意義、文獻(xiàn)綜述與研究設(shè)計(jì),通過(guò)國(guó)內(nèi)外社區(qū)矯正立法與地位的總結(jié)分析,確定了社會(huì)工作介入社區(qū)矯正的價(jià)值取向,是提升社區(qū)矯正效果的重要途徑。本章節(jié)回顧了社區(qū)矯正的發(fā)展歷程,總結(jié)了國(guó)內(nèi)外社會(huì)工作介入社區(qū)矯正的相關(guān)研究,界定了相關(guān)概念,引用了相關(guān)理論基礎(chǔ),介紹了本文的研究方法。第二部分,即第二章,具體分析了甘肅省D市社區(qū)矯正及其社會(huì)工作介入社區(qū)矯正的現(xiàn)狀,通過(guò)案例呈現(xiàn)體現(xiàn)出社會(huì)工作介入社區(qū)矯正的現(xiàn)實(shí)情況,并提出疑問(wèn)。第三部分,即第三章,針對(duì)第二部分提出的疑問(wèn)進(jìn)行剖析,從觀念、專(zhuān)業(yè)、制度、渠道、評(píng)估五方面,通過(guò)調(diào)研數(shù)據(jù)和案例分析,探討D市社會(huì)工作介入社區(qū)矯正的深層問(wèn)題。第四部分,即第四章,路徑設(shè)計(jì)。從間接介入、直接介入和混合介入三方面探討,研究適合甘肅地區(qū)的社會(huì)工作介入社區(qū)矯正的本土化路徑。
[Abstract]:Community correction is a more humanized and socialized way of carrying out punishment than imprisonment correction. Since its implementation in western countries in the late 19th century, because of its development in human rights,The unique advantage of benefit principle and both punitive and restorative value have become the developing trend of penalty system reform and penalty enforcement in many countries in the world.From 2003 to 2009, the whole country formally launched the community correction work. After six years of exploration and summary, a relatively complete community correction system was formed, and the implementation measures of Community Correction in 2012 was issued.The system of community correction in our country has entered the orbit of institutionalization and standardization. "Social workers and volunteers participate in the work of community correction under the guidance of the organization of community correction organization", which is clearly stipulated in the "implementation measures of Community Correction".However, due to the influence of ideology, institution establishment and economic construction, it is difficult for Chinese social workers to get involved in community correction, especially in Gansu province, which is located in the underdeveloped area of northwest China.In community correction, the intervention of social workers is the best choice to efficiently correct their criminal psychology and behavior by using professional ideas and methods, and it is also the best way to give full play to social workers linking various social resources.Integrating the comparative advantages of various social forces to help community correction personnel to return to society smoothly, the inevitable requirements of feeding the society.The successful experience of community correction in western developed countries and the innovative practice of community correction in Shanghai, Hong Kong, Macao and Taiwan have fully proved that the social work intervention of community correction is very necessary.Through the field investigation in D City of Gansu Province, this study combed the development of community correction in Gansu province in detail, and accurately explored the social work intervention breadth, depth and difficulty degree of community correction.Focus on community correction of social work intervention analysis and path design.This paper consists of four parts: the first part, the first chapter, introduces the research background and significance, literature review and research design, through the domestic and foreign community correction legislation and status summary analysis.The value orientation of social work intervention in community correction is an important way to improve the effect of community correction.This chapter reviews the development of community correction, summarizes the relevant research on social work intervention in community correction at home and abroad, defines the relevant concepts, quotes the relevant theoretical basis, and introduces the research methods of this paper.The second part, the second chapter, analyzes the current situation of community correction and social work intervention in D city of Gansu province, and presents the reality of social work intervention in community correction through cases, and puts forward some questions.The third part, the third chapter, analyzes the questions raised in the second part. From the five aspects of concept, specialty, system, channel and evaluation, through the investigation data and case analysis, this paper discusses the deep problems of social work intervention in community correction in D city.The fourth part, namely the fourth chapter, the path design.From the three aspects of indirect intervention, direct intervention and mixed intervention, this paper studies the localization of social work intervention in community correction in Gansu.
