【摘要】：《2006年海事勞工公約》即將在我國正式生效,中國作為一個(gè)航運(yùn)大國和船員輸出大國,同時(shí)承擔(dān)著船旗國與船員國籍國的雙重責(zé)任,因此按照公約要求完善我國船員社會(huì)保障制度已成當(dāng)務(wù)之急。船員社會(huì)保險(xiǎn)作為船員社會(huì)保障的一個(gè)核心內(nèi)容,更成為制度完善過程中的重中之重。雖然我國在船員社會(huì)保障方面已做出了一定的成績,但是與國際組織和其他國家相比,仍存在不足之處。目前實(shí)務(wù)中,我國仍參照陸上勞動(dòng)者的相關(guān)法律法規(guī)來規(guī)范和執(zhí)行船員社會(huì)保險(xiǎn)相關(guān)問題,導(dǎo)致實(shí)踐中產(chǎn)生了許多法律問題�？紤]到船員在海上勞動(dòng)的特殊性,我國完全有必要按照《2006年海事勞工公約》的最低要求加強(qiáng)船員社會(huì)保險(xiǎn)方面的立法,完善我國的船員的社會(huì)保險(xiǎn)制度。本文對(duì)船員概念、海上勞動(dòng)特征以及對(duì)我國船員社會(huì)保險(xiǎn)現(xiàn)狀,包括立法與實(shí)踐兩個(gè)方面進(jìn)行了論述,并針對(duì)現(xiàn)狀中存在的法律問題進(jìn)行了分析,在此基礎(chǔ)上,提出相應(yīng)的解決對(duì)策,以達(dá)到充分保障船員權(quán)益的最終目的,并以此維持我國船員隊(duì)伍的穩(wěn)定,促進(jìn)我國航運(yùn)事業(yè)的發(fā)展。本文包括引言、正文和結(jié)論,正文劃分為五章。第一章界定了本文中船員的概念,對(duì)船員海上勞動(dòng)的特點(diǎn)進(jìn)行了歸納總結(jié),并在此基礎(chǔ)上,對(duì)船員社會(huì)保險(xiǎn)的各項(xiàng)內(nèi)容進(jìn)行了闡述;第二章對(duì)《2006年海事勞工公約》中關(guān)于船員社會(huì)保險(xiǎn)的要求進(jìn)行了闡述;第三章從立法和實(shí)踐兩個(gè)方面對(duì)我國船員社會(huì)保險(xiǎn)的現(xiàn)狀進(jìn)行了論述;第四章對(duì)我國船員社會(huì)保險(xiǎn)制度存在的法律問題進(jìn)行了總結(jié)分析;第五章根據(jù)《2006年海事勞工公約》的要求,借鑒其他國家的先進(jìn)立法經(jīng)驗(yàn),對(duì)我國船員社會(huì)保險(xiǎn)制度的完善提出了對(duì)策建議。
[Abstract]:The Maritime Labour Convention of 2006 is about to enter into force in China. China, as a shipping country and a large exporter of crew members, bears the dual responsibilities of the flag State and the crew nationality state. Therefore, in accordance with the requirements of the Convention, it has become an urgent task to improve the social security system of crew members in our country. As a core content of crew social security, crew social insurance has become the most important thing in the process of system improvement. Although our country has made some achievements in the social security of crew, compared with international organizations and other countries, there are still some shortcomings. At present, China still refers to the relevant laws and regulations of land workers to standardize and implement the related problems of crew social insurance, resulting in a lot of legal problems in practice. Considering the particularity of crew working at sea, it is necessary for our country to strengthen the legislation of crew social insurance according to the minimum requirements of 2006 Maritime Labor Convention, and to perfect the social insurance system of crew in our country. This paper discusses the concept of crew, the characteristics of marine labor and the present situation of crew social insurance in our country, including legislation and practice, and analyzes the legal problems existing in the present situation. On this basis, The corresponding countermeasures are put forward in order to fully protect the rights and interests of the crew, so as to maintain the stability of the crew in our country and promote the development of shipping in our country. This paper includes introduction, main body and conclusion, the main body is divided into five chapters. The first chapter defines the concept of crew in this paper, summarizes the characteristics of crew labor at sea, and on this basis, expounds the contents of crew social insurance. The second chapter expounds the requirements of crew social insurance in the 2006 Maritime Labour Convention, and the third chapter discusses the present situation of crew social insurance in China from two aspects of legislation and practice. The fourth chapter summarizes and analyzes the legal problems existing in the crew social insurance system of our country. In the fifth chapter, according to the requirements of the 2006 Maritime Labour Convention and drawing lessons from the advanced legislative experience of other countries, the fifth chapter puts forward some countermeasures and suggestions for the improvement of the crew social insurance system in our country.
