【摘要】：馬克思主義法治理論中國(guó)化,是在總結(jié)中國(guó)共產(chǎn)黨領(lǐng)導(dǎo)治理國(guó)家與社會(huì)的實(shí)踐經(jīng)驗(yàn),并使之上升為理論,豐富和發(fā)展馬克思主義法治理論,形成中國(guó)化的馬克思主義法治理論,是馬克思主義法學(xué)中國(guó)化的重要組成部分。馬克思主義法治理論中國(guó)化,就是運(yùn)用馬克思主義基本原理,將馬克思主義法治理論,運(yùn)用于中國(guó)法治建設(shè)實(shí)踐的過(guò)程。馬克思主義法治理論為中國(guó)的法治建設(shè)提供了重要的理論指導(dǎo),而中國(guó)共產(chǎn)黨人在堅(jiān)持不懈的社會(huì)主義法治建設(shè)中,也在不斷地豐富、完善馬克思主義的法治理論。在這一過(guò)程中,我們正確解答了國(guó)家與政黨、政黨與法律、政黨與人民、人民與法律、人民與國(guó)家等的關(guān)系問(wèn)題,探尋了國(guó)家實(shí)現(xiàn)長(zhǎng)治久安的治理方式,摸索了實(shí)現(xiàn)人的自由與解放的基本路徑。 馬克思主義法治理論中國(guó)化的歷史進(jìn)程,是一個(gè)漫長(zhǎng)的過(guò)程,也經(jīng)受過(guò)像“文化大革命”那樣的很多嚴(yán)重挫折,有著深重的歷史教訓(xùn)。但是在馬克思主義法治理論中國(guó)化的過(guò)程中,我們黨始終堅(jiān)持住了馬克思主義的基本立場(chǎng)和方法,取得了一些基本經(jīng)驗(yàn)。首先,正確地解決了黨的領(lǐng)導(dǎo)、人民當(dāng)家作主與依法治國(guó)三者之間的關(guān)系。其次,創(chuàng)造性地賦予了馬克思主義法治理論以民族特性和民族氣派。通過(guò)黨的特殊的群眾動(dòng)員機(jī)制使馬克思主義法治理論真正地與中國(guó)社會(huì)的法治實(shí)踐相結(jié)合,并且得到不斷的發(fā)展。同時(shí),隨著時(shí)代的不斷變化,不斷賦予了馬克思主義法治以鮮明的時(shí)代特色,使它與時(shí)俱進(jìn)不斷豐富和發(fā)展,更好地服務(wù)于社會(huì)主義建設(shè)。獲取了某些啟示:只有準(zhǔn)確理解馬克思主義法治思想的核心要義,順應(yīng)時(shí)代、立足中國(guó)法治實(shí)踐,推進(jìn)中國(guó)法治建設(shè);也只有正確處理馬克思主義法治基本原理與傳統(tǒng)法治資源的關(guān)系,才能發(fā)展馬克思主義法治理論;只有敢于并善于批判繼承西方法治資源,才能在交鋒和論爭(zhēng)中加強(qiáng)和完善自身。 通過(guò)對(duì)馬克思、恩格斯和列寧等經(jīng)典作家法治思想的學(xué)習(xí)與吸收,經(jīng)過(guò)近90年的發(fā)展,馬克思主義法治理論的中國(guó)化取得了豐碩的成果:毛澤東思想中的人民民主專政和人民民主法制理論和中國(guó)特色社會(huì)主義法治理論體系。中國(guó)特色社會(huì)主義法治理論體系,體現(xiàn)在鄧小平理論、“三個(gè)代表”重要思想、科學(xué)發(fā)展觀與和諧社會(huì)建設(shè)等關(guān)于民主與法治建設(shè)的重要理論中,其中“在科學(xué)發(fā)展觀指導(dǎo)下,堅(jiān)持黨的領(lǐng)導(dǎo)、人民當(dāng)家作主、依法治國(guó)的有機(jī)統(tǒng)一”是中國(guó)化的馬克思主義法治理論核心中的核心。 馬克思主義法治理論中國(guó)化的問(wèn)題,是一個(gè)永恒的主題。我們已經(jīng)進(jìn)入到了社會(huì)主義民主法治建設(shè)新時(shí)期,面臨著新形勢(shì)新任務(wù)新課題的考驗(yàn)。環(huán)視當(dāng)前的中國(guó)化馬克思主義法治理論,無(wú)論是在內(nèi)部理論結(jié)構(gòu)還是理論與其他社會(huì)存在的外部關(guān)系上,還存在諸多挑戰(zhàn),比如:馬克思主義法治理論尚未完全展開(kāi),一些基本問(wèn)題有待深入解決;法律的實(shí)踐性對(duì)馬克思主義法治理論的進(jìn)化提出了更高的要求;中國(guó)化的馬克思主義法治理論在時(shí)代發(fā)展的驅(qū)動(dòng)下,面臨重大突破的壓力等。馬克思主義法治理論中國(guó)化,是馬克思主義系統(tǒng)性工程中重要的一環(huán)。作為系統(tǒng)工程,在中國(guó)化的馬克思主義法治理論建設(shè)過(guò)程中,我們必須根據(jù)中心工作,選準(zhǔn)、瞄準(zhǔn)建設(shè)目標(biāo),有重點(diǎn)、有層次的推進(jìn),將國(guó)家的法治狀況、社會(huì)的法治秩序、民眾的法治意識(shí)提升到一個(gè)新的境界,以實(shí)現(xiàn)富民強(qiáng)國(guó)、長(zhǎng)治久安的美好愿景。
