【摘要】：網(wǎng)絡(luò)環(huán)境下知識(shí)產(chǎn)權(quán)的傳統(tǒng)特征有所變化,并呈現(xiàn)出權(quán)利對(duì)象多樣化、作品的技術(shù)性更強(qiáng)等新的特征。當(dāng)前,我國(guó)網(wǎng)絡(luò)知識(shí)產(chǎn)權(quán)保護(hù)面臨法律規(guī)定不完善、主體身份確定難、證據(jù)收集與保存難、侵權(quán)責(zé)任認(rèn)定難等困境。為貫徹國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略,解決網(wǎng)絡(luò)知識(shí)產(chǎn)權(quán)糾紛,我國(guó)應(yīng)從現(xiàn)實(shí)需求出發(fā),借鑒國(guó)外相關(guān)經(jīng)驗(yàn),構(gòu)建完備的網(wǎng)絡(luò)知識(shí)產(chǎn)權(quán)保護(hù)法律體系,強(qiáng)化知識(shí)產(chǎn)權(quán)行政執(zhí)法和司法保護(hù),增強(qiáng)公民的網(wǎng)絡(luò)知識(shí)產(chǎn)權(quán)保護(hù)意識(shí)。
[Abstract]:Under the network environment, the traditional characteristics of intellectual property have been changed, and the new features such as the diversity of the right objects and the more technical features of the works are presented. At present, the protection of network intellectual property rights in our country is faced with some difficulties, such as imperfection of laws and regulations, determination of subject identity, collection and preservation of evidence, identification of tort liability, and so on. In order to carry out the national intellectual property strategy and solve the network intellectual property disputes, our country should start from the actual demand, draw lessons from the relevant experience of foreign countries, construct a complete network intellectual property protection legal system, strengthen the intellectual property administrative law enforcement and judicial protection. Enhance citizens' awareness of the protection of intellectual property rights on the Internet.
