【摘要】：黨的十五大報(bào)告明確提出了“依法治國,建設(shè)社會(huì)主義法治國家”的基本方略。而社會(huì)主義和諧社會(huì)的構(gòu)建,重點(diǎn)在農(nóng)村,難點(diǎn)也在農(nóng)村,而民主法治是社會(huì)主義和諧社會(huì)的基本內(nèi)涵,是構(gòu)建社會(huì)主義和諧社會(huì)的基本運(yùn)行機(jī)制,所以關(guān)鍵是要不斷加強(qiáng)社會(huì)主義民主法治,努力完善村民自治,為構(gòu)建社會(huì)主義和諧新農(nóng)村提供堅(jiān)強(qiáng)有力的法治保障。隨著“實(shí)現(xiàn)中部崛起”的提出,中部六省又作為農(nóng)業(yè)大省,穩(wěn)定的農(nóng)村環(huán)境在中部崛起的形勢中占有不可代替的地位,構(gòu)建和諧的中部農(nóng)村環(huán)境,農(nóng)村法治的完善是建立中部農(nóng)村和諧環(huán)境的保障,從而為中部崛起的實(shí)現(xiàn)奠定堅(jiān)實(shí)的基礎(chǔ)。把握中部農(nóng)村動(dòng)態(tài),建立法治防御系統(tǒng),維護(hù)中部農(nóng)村的利益,對(duì)實(shí)現(xiàn)中部崛起打下穩(wěn)定的基礎(chǔ)。 本文以中部農(nóng)村法治建設(shè)作為研究對(duì)象,在對(duì)中部農(nóng)村法治基本內(nèi)容探討的基礎(chǔ)上,從中部農(nóng)村法治的意義、現(xiàn)狀、完善的途徑來分析,從而為建設(shè)良好的中部農(nóng)村法治環(huán)境提供有力的參考。本文共分為四個(gè)部分: 第一部分:農(nóng)村法治的基本理念。這一部分主要對(duì)法治和農(nóng)村法治加以闡述和分析,從而引出中部農(nóng)村法治建設(shè),從而為后文的展開奠定基礎(chǔ),并具體闡述加強(qiáng)中部農(nóng)村法治所遵循的基本原則,指導(dǎo)中部農(nóng)村法治的建設(shè)。 第二部分:加強(qiáng)中部農(nóng)村法治的意義。這一部分從四個(gè)方面加以闡述,分別是加強(qiáng)中部農(nóng)村加強(qiáng)中部農(nóng)村法治是中部“農(nóng)業(yè)大省”的省情所決定的,加強(qiáng)中部農(nóng)村法治是促進(jìn)中部崛起的堅(jiān)實(shí)后盾,加強(qiáng)中部農(nóng)村法治是依法治國戰(zhàn)略的內(nèi)在要求以及加強(qiáng)中部農(nóng)村法治是社會(huì)主義新農(nóng)村建設(shè)的保障,從而為我們加強(qiáng)中部農(nóng)村法治建設(shè)提供依據(jù)。 第三部分:當(dāng)前中部農(nóng)村法治的現(xiàn)狀。首先對(duì)中部農(nóng)村的現(xiàn)狀加以總結(jié),然后對(duì)中部農(nóng)村法治面臨的問題進(jìn)行具體分析,明細(xì)現(xiàn)狀,加以比較,從而才能做出決策。 第四部分:中部農(nóng)村完善法治的途徑。首先參考國外的農(nóng)村法律制度,尋找合乎中部農(nóng)村發(fā)展特點(diǎn)的法治思路。其次立足本土特色,聯(lián)系實(shí)際提出中部農(nóng)村法治建設(shè)途徑,為我國中部農(nóng)村法治建設(shè)貢獻(xiàn)力量。
[Abstract]:The report of the 15th National Congress of the Party clearly put forward the basic strategy of governing the country according to law and building a socialist country ruled by law. The construction of the socialist harmonious society is focused on the countryside, and the difficulty is also in the countryside. Democracy and the rule of law are the basic connotation of the socialist harmonious society and the basic operating mechanism of the construction of the socialist harmonious society. So the key is to constantly strengthen socialist democracy and rule of law, strive to improve villagers' autonomy, and provide a strong and powerful legal guarantee for the construction of a new socialist harmonious countryside. With the proposition of "realizing the rise of Central China", six provinces of Central China, as a big agricultural province, the stable rural environment occupies an irreplaceable position in the situation of the rise of the Central China, and constructs the harmonious rural environment of the Central China. The perfection of the rural rule of law is the guarantee of establishing the harmonious environment in the central countryside, thus laying a solid foundation for the realization of the rise of the central region. Grasping the dynamics of the central countryside, establishing the defense system of the rule of law, safeguarding the interests of the central countryside, and laying a stable foundation for the realization of the rise of the central region. Based on the discussion of the basic contents of the rule of law in the central rural areas, this paper takes the construction of the rule of law in the central countryside as the research object, and analyzes the significance, the present situation and the perfect ways of the rule of law in the rural areas of the central region. So as to build a good central rural legal environment to provide a strong reference. This article is divided into four parts: the first part: the basic concept of rural rule of law. This part mainly expounds and analyzes the rule of law and the rural rule of law, which leads to the construction of the rule of law in the central rural areas, thus laying the foundation for the later development, and concretely expounds the basic principles to be followed in strengthening the rule of law in the central rural areas. To guide the construction of the rule of law in central rural areas. The second part: the significance of strengthening the rule of law in the central countryside. This part is elaborated from four aspects: strengthening the rule of law in the rural areas of the central region is decided by the provincial situation of the "big agricultural province" in the central region, and strengthening the rule of law in the rural areas of the central region is the solid backing to promote the rise of the central region. Strengthening the rule of law in the central countryside is the inherent requirement of the strategy of governing the country according to law, and strengthening the rule of law in the central countryside is the guarantee of the construction of the new socialist countryside, thus providing the basis for us to strengthen the construction of the rule of law in the central countryside. The third part: the present situation of the rule of law in the central countryside. Firstly, the paper summarizes the present situation of the central rural areas, and then analyzes the problems facing the rule of law in the central rural areas, details the current situation, compares them, and then makes a decision. The fourth part: the way to perfect the rule of law in the central countryside. First of all, referring to the foreign rural legal system, looking for the central rural development characteristics of the rule of law. Secondly, based on the local characteristics, the author puts forward the ways to build the rule of law in the rural areas of central China, which will contribute to the construction of the rule of law in the rural areas of central China.
