【摘要】：社會(huì)公共性衰微是當(dāng)前農(nóng)村基層治理的難點(diǎn)問題。立足于農(nóng)村現(xiàn)代化轉(zhuǎn)型的社會(huì)語境,現(xiàn)代法治得以進(jìn)入農(nóng)村公共性難題化解的實(shí)踐場域,在"送法下鄉(xiāng)"與"迎法下鄉(xiāng)"的互動(dòng)過程中確定其入場路徑,于正式規(guī)則與非正式規(guī)則的交織融合中獲得具體的入場形態(tài)。法治之于農(nóng)村基層治理公共性難題化解的作用發(fā)揮,其基礎(chǔ)在于法治本身的豐富功能,其操作則應(yīng)著眼于農(nóng)村社會(huì)主體公共性的制度構(gòu)建、行為公共性的規(guī)范依據(jù)提供以及農(nóng)村公共性實(shí)踐的法律保障等方面。基于法治自身發(fā)展程度、法律的內(nèi)在局限以及法律規(guī)范與農(nóng)村其他社會(huì)規(guī)范相容程度等限制,法治之于農(nóng)村基層治理公共性難題化解的作用發(fā)揮也存在不可忽視的邊界。
[Abstract]:The decline of social publicity is a difficult problem in rural grassroots governance. Based on the social context of the rural modernization transformation, the modern rule of law can enter the practical field of resolving the rural public problems, and determine its entrance path in the interactive process of "sending the law to the countryside" and "welcoming the law to the countryside". In the formal rules and informal rules intertwined to obtain the specific admission pattern. The function of the rule of law in solving the problems of rural grass-roots governance is based on the rich function of the rule of law itself, and its operation should focus on the system construction of the public nature of the main body of the rural society. The normative basis of behavior publicity and the legal protection of rural public practice and so on. Based on the degree of development of the rule of law itself, the inherent limitations of the law and the compatibility of the legal norms with other social norms in rural areas, there is also a boundary that can not be ignored in the role of the rule of law in resolving the public problems of rural grass-roots governance.
