【摘要】：環(huán)境法治是一個(gè)國(guó)家整體法治建設(shè)進(jìn)程的有效組成部分,也是其發(fā)展映射。目前我國(guó)環(huán)境法治步履維艱,難收其效。既有環(huán)境法律制度本身內(nèi)生性的制度欠缺,又有基于傳統(tǒng)歷史發(fā)展形成的外部機(jī)制的制約與影響。就環(huán)境司法而言,其作為權(quán)利救濟(jì)及環(huán)境保護(hù)的最后一道防線,承載環(huán)境法治思想的裁判文書(shū)的說(shuō)理釋法性尤為重要,這不僅是環(huán)境法治達(dá)至的需要,亦是我國(guó)司法改革的重要議題。
[Abstract]:Environmental rule of law is an effective part of the process of a country's overall construction of rule of law, and also a mapping of its development. At present, the environmental rule of law in our country is very difficult to achieve. The environmental legal system is not only lack of endogenous system, but also the restriction and influence of the external mechanism formed by the traditional historical development. As far as environmental justice is concerned, as the last line of defense of right relief and environmental protection, the reasoning and interpretation of the judgment document carrying the thought of environmental rule of law is particularly important, which is not only the need of environmental rule by law. It is also an important topic of judicial reform in China.
