【摘要】：隨著依法治教、依法治校的不斷深入,家長(zhǎng)委員會(huì)作為現(xiàn)代教育中家校合作的新形式,越來越受到關(guān)注、重視。家長(zhǎng)委員會(huì)的誕生幫助越來越多的家長(zhǎng)了解學(xué)校的相關(guān)政策,使家長(zhǎng)在學(xué)校做出重大決定方面擁有話語權(quán)、參與權(quán)、監(jiān)督權(quán)以及知情權(quán)等。除此之外,家長(zhǎng)委員會(huì)的成立還能夠?qū)W(xué)生進(jìn)行全方位的教育,為學(xué)生營(yíng)造出理解、信任、配合、和諧的育人環(huán)境。基于對(duì)以往研究中存在不足的反思以及對(duì)現(xiàn)有研究的分析,本文以“小學(xué)家長(zhǎng)委員會(huì)”為切入點(diǎn),對(duì)家長(zhǎng)委員會(huì)在成立、運(yùn)行時(shí)的法治化現(xiàn)狀進(jìn)行深入的分析。與以往相關(guān)論題不同的是,本論文以法律的視角對(duì)家長(zhǎng)委員會(huì)的法治化現(xiàn)狀以及如何成為更加完善、更加符合法治要求的組織進(jìn)行論述。在研究過程中,本文主要采用實(shí)地調(diào)查研究以及訪談法等,以對(duì)各個(gè)小學(xué)家長(zhǎng)委員會(huì)的成立情況為基礎(chǔ),進(jìn)一步研究其在成立過程中相關(guān)程序是否符合法治化的標(biāo)準(zhǔn)、準(zhǔn)則。通過觀察、參與家長(zhǎng)委員會(huì)的實(shí)際運(yùn)行情況結(jié)合家長(zhǎng)、社會(huì)各方面對(duì)該組織的評(píng)價(jià),進(jìn)一步對(duì)其實(shí)施現(xiàn)狀進(jìn)行分析,明確問題,提出法治化的解決措施,從而使其在成立、運(yùn)行方面更加完善。研究發(fā)現(xiàn),在小學(xué)家長(zhǎng)委員會(huì)的成立以及實(shí)際運(yùn)行中,家長(zhǎng)委員會(huì)暴露、呈現(xiàn)出許多問題,這些問題的出現(xiàn)使其違背了法治化的要求、違背了當(dāng)前法治化的現(xiàn)狀,嚴(yán)重的阻止了其走向法治化的道路。例如:家長(zhǎng)委員會(huì)成員選拔不規(guī)范,成員存在連任,學(xué)校的家長(zhǎng)委員會(huì)制度中對(duì)連任情況沒有任何說明,家長(zhǎng)委員會(huì)制度、章程的不完善以及沒有固定的辦公場(chǎng)所等。在家長(zhǎng)委員會(huì)的實(shí)際運(yùn)行過程中違背法治化的標(biāo)準(zhǔn),如家長(zhǎng)委員會(huì)成員權(quán)力的異化與缺位、委員會(huì)成員權(quán)力救濟(jì)的缺失、教育行政部門及社會(huì)等方面對(duì)其監(jiān)督的缺失、委員會(huì)成員法治意識(shí)淡薄等。因此,本文以法治化的標(biāo)準(zhǔn)提出推進(jìn)、完善小學(xué)家長(zhǎng)委員會(huì)的措施,從成立到運(yùn)行不斷注入法治化的思想,為其成為法治化的家長(zhǎng)委員會(huì)提出對(duì)策建議。
[Abstract]:With the deepening of administering education according to law and running schools according to law, as a new form of cooperation between home and school in modern education, parents' committees have received more and more attention and attention. The birth of parent committees has helped more and more parents to understand the relevant policies of schools. To enable parents to have the right to speak, participate in, supervise and know about major decisions made by schools. In addition, the establishment of parent committees can also provide students with comprehensive education, creating understanding, trust and cooperation for students. The harmonious educational environment. Based on the reflection of the shortcomings of the previous research and the analysis of the existing research, this paper takes the "Primary School parents Committee" as the starting point, and sets up the parent Committee. The current situation of the rule of law in the running time is deeply analyzed. Different from the previous related topics, this paper has a legal perspective on the status quo of the rule of law of the parent committee and how to become more perfect. In the course of the research, this paper mainly adopts field investigation and interview method, which is based on the establishment of parents' committees in each primary school. Further study on whether the relevant procedures in the process of its establishment conform to the standards and guidelines of the rule of law. Through observation, participation in the actual operation of the parents' committee and the evaluation of the organization by all sectors of society, Further analysis of the status quo of its implementation, clear problems, put forward legal solutions, so as to make it more perfect in the establishment and operation. The study found that in the establishment of primary school parents' committee and the actual operation, The parents' Committee exposed many problems, which made them run counter to the requirements of the rule of law and the current situation of the rule of law. It has seriously blocked its path to rule of law. For example, the selection of members of parent committees is not standardized, members are re-elected, there is no explanation for re-election in the school's parent committee system, and there is a parent committee system. The imperfect articles of association and the lack of fixed office space, etc. In the actual operation of the parent committee, it violates the standard of rule of law, such as the alienation and absence of the power of the members of the parent committee, the lack of the power relief of the members of the committee, and so on. The lack of supervision by the educational administrative department and the society, the weak sense of rule of law among the members of the committee, etc. Therefore, this paper puts forward the measures to improve the primary school parents' committee by the standard of rule of law. From its establishment to operation, it continuously infuses the thought of rule by law, and puts forward countermeasures and suggestions for its becoming the parents' committee of rule by law.
