【摘要】： 煤炭資源是我國(guó)最為重要的戰(zhàn)略資源,是我國(guó)社會(huì)經(jīng)濟(jì)得以高速發(fā)展的物質(zhì)基礎(chǔ)。作為我國(guó)的煤炭資源大省,長(zhǎng)期以來(lái),山西省以其豐富的煤炭資源為我國(guó)國(guó)民經(jīng)濟(jì)的持續(xù)健康快速發(fā)展與人民生活水平的不斷穩(wěn)步提高做出了不可估量的貢獻(xiàn),因此,其被公認(rèn)為是我國(guó)國(guó)民經(jīng)濟(jì)的“發(fā)動(dòng)機(jī)”和國(guó)民經(jīng)濟(jì)的“心臟”。然而,在山西省的煤炭資源開發(fā)利用過程中尚且存在許多的問題與不足長(zhǎng)期未能得到有效的解決和控制,已經(jīng)嚴(yán)重的阻礙了可持續(xù)發(fā)展戰(zhàn)略的進(jìn)程。資源浪費(fèi)、環(huán)境污染、礦山事故已經(jīng)成為了人們的心腹之患,而如何使山西省的煤炭資源可持續(xù)開發(fā)利用盡早實(shí)現(xiàn)法治化,也已經(jīng)成為了全社會(huì)所關(guān)注的焦點(diǎn)。在此背景下,本文緊密聯(lián)系山西省的實(shí)際狀況,把握主要矛盾,以煤炭資源執(zhí)法為視角對(duì)其法治化進(jìn)程中的主要的問題或障礙進(jìn)行切入和分析。 作為一門交叉學(xué)科,環(huán)境與資源保護(hù)法學(xué)必須與其他相關(guān)學(xué)科緊密聯(lián)系,并實(shí)踐于各行業(yè)才能夠真正體現(xiàn)出其價(jià)值。本文堅(jiān)持以一切有利于研究為原則,堅(jiān)持以法學(xué)知識(shí)為主體,廣泛運(yùn)用經(jīng)濟(jì)學(xué)、社會(huì)學(xué)、管理學(xué)、環(huán)境學(xué)、統(tǒng)計(jì)學(xué)等多學(xué)科的知識(shí),有針對(duì)性的采用了實(shí)證分析的研究方法,主要進(jìn)行了以下研究工作：第一,本文分析了山西省實(shí)現(xiàn)煤炭資源可持續(xù)開發(fā)利用的理論基礎(chǔ)與現(xiàn)實(shí)基礎(chǔ),為后續(xù)研究的展開奠定了基礎(chǔ)。第二,論證了山西省煤炭資源可持續(xù)開發(fā)利用實(shí)現(xiàn)法治化的必要性與可行性,將法治化的實(shí)現(xiàn)作為研究方向。第三,在對(duì)山西省個(gè)別典型的礦山、企業(yè)和政府執(zhí)法部門進(jìn)行實(shí)地走訪、調(diào)研的基礎(chǔ)上,本文較為全面的發(fā)掘和分析了煤炭資源開發(fā)利用過程中在執(zhí)法環(huán)節(jié)所存在的問題與缺陷,運(yùn)用了理論聯(lián)系實(shí)際與實(shí)證的方法,綜合運(yùn)用了多學(xué)科的知識(shí)對(duì)山西省煤炭資源可持續(xù)開發(fā)利用法治化的完善進(jìn)行了研究。最后,在上述研究的基礎(chǔ)上,提出了相應(yīng)的對(duì)策。
[Abstract]:Coal resource is the most important strategic resource in our country and the material foundation for the rapid development of our social economy. As a big province of coal resources in our country, for a long time, Shanxi Province has made inestimable contributions to the sustained, healthy and rapid development of the national economy and the steady improvement of the people's living standards with its abundant coal resources. It is recognized as the "engine" of our national economy and the "heart" of the national economy. However, there are still many problems and shortcomings in the development and utilization of coal resources in Shanxi Province, which have not been effectively solved and controlled for a long time. Has seriously hindered the process of sustainable development strategy. The waste of resources, environmental pollution, mine accidents has become a problem of people, and how to make the sustainable development and utilization of coal resources in Shanxi Province as soon as possible to achieve the rule of law, It has also become the focus of attention of the whole society. Under this background, this paper closely relates to the actual situation in Shanxi Province and grasps the principal contradictions. From the perspective of law enforcement of coal resources, the main problems or obstacles in the process of ruling by law are analyzed. As an interdisciplinary subject, environmental and resource protection law must be closely related to other relevant disciplines, and practice in various industries to truly reflect its value. Adhere to the knowledge of law as the main body, the extensive use of economics, sociology, management, environmental science, statistics and other multidisciplinary knowledge, targeted use of empirical analysis of research methods, mainly carried out the following research work: first, This paper analyzes the theoretical and practical basis of realizing the sustainable development and utilization of coal resources in Shanxi Province, which lays a foundation for further research. This paper demonstrates the necessity and feasibility of the sustainable exploitation and utilization of coal resources in Shanxi Province, and takes the realization of the rule of law as the research direction. Thirdly, it makes field visits to some typical mines, enterprises and government law enforcement departments in Shanxi Province. On the basis of investigation and research, this paper comprehensively explores and analyzes the problems and defects in the law enforcement in the process of coal resources development and utilization, and applies the method of combining theory with practice and empirical evidence. This paper studies the perfection of the sustainable exploitation and utilization of coal resources in Shanxi Province by means of multi-disciplinary knowledge. Finally, on the basis of the above research, the corresponding countermeasures are put forward.
