【摘要】：隨著我國社會主義法治建設(shè)進程的不斷推進,近年來,如聶樹斌案、復(fù)旦投毒案等一系列典型法制案例報道越來越多地受到黨和政府的重視,在受眾中也得到了廣泛地關(guān)注。典型法制案例報道意義重大,可以以活生生的法制案例給受眾以形象生動的教育,喚醒人們的法律意識,起到潛移默化的作用。正是基于此,媒體特別是黨報,充分意識到典型法制案例報道的重要性,但同時在報道中也出現(xiàn)了些許問題。然而,根據(jù)筆者對“典型法制案例報道”這一關(guān)鍵詞所做的學(xué)術(shù)史梳理來看,學(xué)界對此的研究幾乎是一個空白。中國知網(wǎng)數(shù)據(jù)庫中,對于法制案例報道的論文也只有7篇,主要是對法制案例報道的新聞選擇、價值、及物性系統(tǒng)研究、功能等方面進行研究。《光明日報》作為新中國成立之初由民主同盟創(chuàng)辦的以知識分子為主要對象的報紙,承擔(dān)著貫徹黨中央的方針政策、宣傳無產(chǎn)階級文化思想的任務(wù)。因此,《光明日報》自創(chuàng)生以來就獨樹一幟,與其他中共黨報相比具有鮮明的特征,其典型法制案例報道也有其鮮明的特征。本研究選擇以《光明日報》典型法制案例報道(1998—2016)為文本,從文本分析的角度,對《光明日報》典型法制案例報道進行探究,通過這一研究,以求填補典型法制案例報道及《光明日報》典型法制案例報道的空白。本研究主要分為四個部分:第一部分主要概述研究對象、研究意義、研究現(xiàn)狀、研究方法及研究范圍的界定等。第二部分通過量化分析、文本分析,對《光明日報》典型法制案例報道進行具體的研究。學(xué)術(shù)上,通常將“法制報道”分為刑事法制、民事法制、經(jīng)濟法制、文教法制、行政法制5類報道,據(jù)此,本研究也將典型法制案例報道分為這5類進行探析,即從典型刑事法制案例報道、典型民事法制案例報道、典型經(jīng)濟法制案例報道、典型文教法制案例報道、典型行政法制案例報道五個角度來研究;分別從體裁分析、版面分布、報道主題等三個方面對五種典型法制案例報道進行文本分析;在對每一類典型法制案例報道研究中,都分別選取了具體典型法制案例來分析,依次選取聶樹斌案、張海超開胸驗肺事件、三鹿奶粉事件、復(fù)旦投毒案、蒼南城管打人事件五個具體案例,以更加深入地對《光明日報》典型法制案例報道進行探析。第三部分主要總結(jié)了第二部分對于《光明日報》文本分析的內(nèi)容,然后從整體上來分析其中三個角度的變化趨勢;其次從整體上分析了《光明日報》典型法制案例報道(1998—2016)的主題話語變遷與措辭風(fēng)格變化。第四部分主要是通過對《光明日報》典型法制案例報道研究,為黨報如何做好法制新聞報道提出對策與建議,主要從遵從“受眾本位論”,體現(xiàn)自身特色;提高新聞工作者法律素養(yǎng),增加受眾法律知識;利用好“媒介偏向理論”,與新媒體互動等三個方面來闡述。在全球化的大背景下,當(dāng)下的中國正處于一個轉(zhuǎn)型時期,即正處于實現(xiàn)“中國夢”的關(guān)鍵時期,與時俱進地審視當(dāng)前黨報典型法制案例報道的“精華”或“糟粕”,有助于新聞界認識到典型法制案例報道的傳播效應(yīng)的優(yōu)缺點,以及受眾的情感共鳴和理性認知,以便于促使媒體更好地履行普法教育、輿論監(jiān)督等職責(zé)。

The typical legal case reports of great significance, can give the audience with vivid education in the case of living law, arouse people's legal consciousness, play a subtle role. However, according to the author of "the typical legal case report" keywords sort of academic history, research in this field is almost a blank.
