【摘要】：秦時"讞獄"之"讞"除了有"疑獄上讞"之義,還有因事件的特殊性或者犯罪主體的特殊身份本級司法機關(guān)無權(quán)決斷而上讞上級司法機關(guān)斷決之義。根據(jù)《岳麓書院藏秦簡(五)》(待出版)中秦令的內(nèi)容,"當(dāng)"作為一種獨立的文書,有固定的格式,附在確定案情的"鞫"文書之后,多見于郡級上讞廷尉的獄案文書中;且這類案件中對于犯罪主體所適用的處罰沒有疑義,而是由于其身份的特殊性,郡無權(quán)處理,需要廷尉或者皇帝來做最后的決斷。
[Abstract]:In the Qin Dynasty, there was not only the meaning of "conviction in prison", but also the meaning of "conviction in prison". Also because of the particularity of the incident or the special identity of the subject of the crime, the judicial organs at the corresponding level have no right to make a decision and the higher judicial organs make a decision. According to the contents of the Qin Ling in the Tibetan slips of Qin (5) > (to be published) in the Yuelu Academy of Classics, "when" As a separate instrument, There is a fixed format that is attached to the "fiduciary" instrument for the determination of the case, and it is more commonly found in the prison case documents of court officers at the county level; and in such cases there is no doubt as to the punishment applicable to the subject of the crime, but rather because of the particularity of his identity, The county had no authority to deal with the matter, and it was for a lieutenant or an emperor to make a final decision.
