【摘要】：《1986年移民改革與控制法》是美國移民法史上第一部針對非法移民的法律。新移民法通過制裁雇主雇傭非法移民、給予境內(nèi)非法移民永久居留權(quán)、制定新的臨時工人引進條例以及加強邊防巡邏等手段,試圖遏制非法移民的涌入。然而新移民法不僅未能有效阻止新移民的入境,反而降低了美國藍(lán)領(lǐng)工人的平均薪酬水平,促成了偽證制造交易市場的形成,使得非法移民在全美境內(nèi)擴散,并吸引了更多的非法移民進入美國。非法移民禁而不絕根本原因在于美國市場對勞動力的需求,而新移民法條款的漏洞以及實施過程中的舞弊行為又使得新法實施效果大打折扣�！�1986年移民改革與控制法》有著重要的借鑒意義,為我國移民管理制度的完善和移民法的創(chuàng)立提供了寶貴的經(jīng)驗教訓(xùn)。
[Abstract]:The Immigration Reform and Control Act of 1986 is the first law in the history of the United States to deal with illegal immigrants. New regulations for the introduction of temporary workers and enhanced border patrols are intended to curb the influx of illegal immigrants. However, the new immigration law has not been effective in preventing new immigrants from entering the country. Instead, it has reduced the average salary of blue-collar workers in the United States, contributed to the creation of a market for perjury manufacturing, and led to the spread of illegal immigrants throughout the country. And has attracted more illegal immigrants into the United States. Illegal immigration ban, the root cause of the U. S. market demand for labor. However, the loopholes in the provisions of the new immigration law and the corrupt practices in the implementation process have greatly reduced the effect of the implementation of the new law. The Immigration Reform and Control Act of 1986 has important significance for reference. It provides valuable experience and lessons for the perfection of immigration management system and the establishment of immigration law.
