【摘要】：養(yǎng)老問題是關(guān)乎家庭與社會和諧的大事。在法治語境下,厘清養(yǎng)老責(zé)任,構(gòu)建新型養(yǎng)老模式,是法治社會建設(shè)的重要議題。文章緒論部分主要介紹了當(dāng)前我國養(yǎng)老問題的現(xiàn)狀,并通過對目前國內(nèi)外有關(guān)養(yǎng)老問題研究情況的具體介紹和分析,提出本文寫作的基本思路、角度和方法,指出法治社會養(yǎng)老問題的出路在于多方力量參與到養(yǎng)老中,重新構(gòu)建一種以家庭為核心的新型養(yǎng)老模式。文章第二部分主要介紹了本文寫作的理論依據(jù),通過對社會權(quán)的概念、歷史淵源、馬克思主義關(guān)于社會權(quán)的基本觀點(diǎn)、法治社會中社會權(quán)基本內(nèi)容的介紹,提出社會權(quán)利具有國家性和相對性,公民社會權(quán)利的保障需要國家和非國家行為體共同努力。文章第三部分主要介紹了我國傳統(tǒng)社會家庭養(yǎng)老的原因、基本內(nèi)容以及面臨的問題。家庭承擔(dān)養(yǎng)老責(zé)任,是我國贍養(yǎng)老人的傳統(tǒng)方式,它不但節(jié)省了國家的養(yǎng)老資源,維護(hù)了社會安定,同時(shí)也滿足了老年人的精神需求。但是在社會權(quán)興起的狀態(tài)下,國家和社會需亦應(yīng)分擔(dān)部分養(yǎng)老責(zé)任。文章第四部分主要介紹隨著經(jīng)濟(jì)的發(fā)展、歷史的變遷和社會的進(jìn)步,在法治社會視域下,家庭養(yǎng)老責(zé)任觀念應(yīng)當(dāng)被賦予新內(nèi)涵,養(yǎng)老并不能全靠家庭,國家和社會也應(yīng)充分發(fā)揮其應(yīng)有的養(yǎng)老功能。同時(shí),詳細(xì)介紹了國家、社會和家庭所各自承擔(dān)的具體養(yǎng)老義務(wù)。文章第五部分主要通過分析國外優(yōu)秀養(yǎng)老經(jīng)驗(yàn),從國外對同一問題的不同解決方法入手,對不同國家的養(yǎng)老模式、養(yǎng)老制度進(jìn)行介紹和對比,揚(yáng)長避短,并結(jié)合中國的實(shí)際國情對其加以借鑒吸收,進(jìn)而為我國法治社會中多元養(yǎng)老責(zé)任的實(shí)現(xiàn)提供一些良性建議。文章最后一部分基于上述幾章的具體介紹分析,指出法治社會下,要破解困擾我國已久的養(yǎng)老難題,就必須對癥下藥,落實(shí)國家、社會和家庭各自承擔(dān)的具體養(yǎng)老義務(wù),并提出重建以家庭為核心的新型養(yǎng)老模式的一些具體對策和措施。
[Abstract]:The problem of supporting the aged is a major event related to the harmony between family and society. In the context of the rule of law, it is an important issue to clarify the responsibility for the aged and to construct a new mode for the aged. The introduction part of the article mainly introduces the current situation of the old-age problem in China, and through the specific introduction and analysis of the current research situation of the old-age problem at home and abroad, puts forward the basic ideas, angles and methods of the writing of this article. It is pointed out that the way out for the old-age problem in the society ruled by law lies in the participation of various forces in the old-age care and the reconstruction of a new old-age model with family as the core. The second part of the article mainly introduces the theoretical basis of this article, through the concept of social rights, historical origin, Marxist basic views on social rights, the basic content of social rights in a society ruled by law. The author points out that social rights are national and relative, and the protection of civil social rights needs the joint efforts of state and non-state actors. The third part mainly introduces the causes, basic contents and problems of the family pension in the traditional society of our country. It is the traditional way to support the elderly in our country. It not only saves the country's endowment resources, maintains the social stability, but also meets the spiritual needs of the elderly. However, in the state of social rights rising, the state and society should also share part of the pension responsibility. The fourth part of the article mainly introduces that with the development of economy, the change of history and the progress of society, the concept of family responsibility for the aged should be endowed with new connotations under the view of the society ruled by law, and the old-age support is not entirely dependent on the family. The state and society should also give full play to their proper pension function. At the same time, the state, the society and the family respectively bear the specific endowment obligations. The fifth part of the article mainly through the analysis of foreign excellent pension experience, starting from the same problem of different solutions abroad, the pension model and pension system in different countries are introduced and compared to promote strengths and circumvent weaknesses. Combined with the actual situation of China to draw lessons from the absorption, and then for the rule of law society in China to achieve the realization of multiple responsibilities for the elderly to provide some sound suggestions. In the last part of the article, based on the specific introduction and analysis of the above chapters, it is pointed out that in order to solve the problem of supporting the aged which has been puzzling our country for a long time, we must take the right medicine to implement the specific obligation of the state, the society and the family to provide for the aged. And put forward some concrete countermeasures and measures to rebuild the new pension model with family as the core.
