【摘要】：雖然對未成年人虞犯行為的內(nèi)涵和外延仍存在諸多爭議,但未成年人虞犯行為應(yīng)當(dāng)進行干預(yù)則已成為學(xué)界與實務(wù)界的共識。從域外發(fā)展來看,虞犯行為的司法干預(yù)經(jīng)歷了全面干預(yù)、限制干預(yù)和廢除干預(yù)的發(fā)展階段。雖然域外少年司法界存在諸多糾結(jié),但從我國情況來看,建立虞犯行為的早期干預(yù)機制仍有其必要性。以監(jiān)護監(jiān)督、親職教育、宵禁、交友限制、傳媒管理等非正式干預(yù)為重點,以警察部門、福利部門等行政干預(yù)為紐帶,以司法干預(yù)為保障的"漏斗式"虞犯早期干預(yù)模式,應(yīng)當(dāng)成為我國虞犯行為早期干預(yù)制度建立的方向。
[Abstract]:Although there are still many controversies on the connotation and extension of the behavior of juvenile delinquency, it has become the consensus of academic and practical circles that intervention should be carried out. From the perspective of extraterritorial development, the judicial intervention of the behavior of dangerous crime has experienced the stage of comprehensive intervention, restriction intervention and abrogation intervention. Although there are many difficulties in the field of juvenile justice in foreign countries, it is necessary to establish the early intervention mechanism of the behavior of risk of crime in view of the situation of our country. Focusing on informal intervention such as guardianship supervision, parental education, curfew, making friends restrictions, media management and so on, taking administrative intervention such as police department and welfare department as the link, and taking judicial intervention as the safeguard, the early intervention mode of "funnel-type" risk offenders, It should be the direction to establish the early intervention system in our country.
